043-16 - Resolution - Contract with Otis Elevator for City Hall Elevator MaintenanceRESOLUTION NO. 043-16 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING ORDINARY MAINTENANCE CONTRACT NO. C051-16 WITH OTIS ELEVATOR COMPANY FOR THE 2016 PORT ORCHARD CITY HALL ELEVATOR PREVENTATIVE MAINTENANCE CONTRACT AND DOCUMENTING THE PROCUREMENT SELECTION PROCEDURES WHEREAS, in 1999, as a function of the newly constructed Port Orchard Municipal Building, Otis Elevator Company furnished and installed a Hydraulic Elevator with industry - standard warranty and maintenance coverage; and WHEREAS, in May 2000, upon acceptance of the elevator installation, the Otis Elevator Company provided to the City of Port Orchard a five (5) year Extended Coverage Maintenance Contract that provided 'automatic renewal' at each fifth anniversary for an additional five (5) year term, unless terminated by either party; and WHEREAS, in 2013, the Otis Elevator Company notified the City of Port Orchard of pending changes in elevator code enforcement and the adoption of new elevator code requirements (ASME 8.6 AN 8.11 Elevator Codes); and WHEREAS, Otis Elevator Company, working with the State of Washington, developed a compliance Maintenance Control Program (MCP) that the State authorized in October 2013 and in January 2014, the State of Washington started enforcing the additional elevator code requirements; and WHEREAS, on December 16, 2015, the City's Public Works Director requested clarification from MRSC regarding the use of Sole Source Contract, whereby Mr. Carpita of MRSC recommended using an Ordinary Maintenance Contract instead; and WHEREAS, on March 21, 2016, the City's Public Works Director coordinated with the City Attorney on the MRSC recommendation by providing background information and to confirm the use of the 1999 Otis Elevator Company Contract with the State of Washington Elevator Code Notice as Exhibit A and B to the City's Ordinary Maintenance Contract instead; and WHEREAS, on March 23, 2016, the City Attorney responded, stating that the use of the 2016 Otis Elevator Company Contract with the State of Washington Elevator Code Notice requirements as Exhibits A and B to the City's Ordinary Maintenance Contract would be a good way to ensure continuity, and to include language within the Ordinary Maintenance Contract that if there are any inconsistencies between the Terms and conditions of the two Contacts, that the terms of the Ordinary Maintenance Contract will control; now, therefore, Resolution No. 043-16 Page 2 of 2 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City Council approves Contract No. 051-16 with Otis Elevator Company, for the 2016 Elevator Preventative Maintenance and adopts the "Whereas" statements contained herein as findings in support of the City's selection of contracting and procurement procedures.
