047-16 - Resolution - Fixing Date of a PH to Vacate Portion of ROW Alley off of Tremont StreetRESOLUTION NO. 047-16 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE DATE OF PUBLIC HEARING ON A PETITION TO VACATE A PORTION OF CITY RIGHT-OF-WAY LOCATED IN THE ALLEY OFF OF TREMONT STREET LEGAL DESCRIPTION OF ALLEY VACATION ALL THAT PORTION OF THE ALLEY LYING BETWEEN BLOCKS 1 AND 2 OF SIDNEY LAND COMPANY'S 2ND ADDITION TO SIDNEY WASHINGTON RECORDED IN VOLUME 2, PAGE 9 OF PLATS, RECORDS OF KITSAP COUNTY, WASHINGTON, LYING NORTH OF THE NORTHERLY RIGHT OF WAY OF TREMONT STREET AND SOUTH OF THE FOLLOWING DESCRIBED LINE: BEGINNING AT THE NORTHEAST CORNER OF LOT 3 OF SAID BLOCK 1; THENCE EASTERLY TO THE NORTHWEST CORNER OF LOT 3 OF SAID BLOCK 2 AND THE TERMINUS OF THIS LINE. SITUATE IN THE NORTHWEST QUARTER OF THE SOUTHWEST QUARTER OF SECTION 35, TOWNSHIP 24 NORTH, RANGE 1 EAST, W.M. CONTAINS 855 SQUARE FEET, MORE OR LESS. WHEREAS, the petitioner, Mr. and Mrs. Ness, has submitted a petition to vacate a portion of City right-of-way located in the Alley off of Tremont Street; and WHEREAS, the petitioners constitute more than two-thirds (2/3) of the owners of the property abutting the area proposed for vacation pursuant to RCW 35.79.010; and WHEREAS, the property sought to be vacated is approximately 855 square feet; and WHEREAS, petitioners have requested that proceedings be had hereon for the vacation of said right-of-way in the manner prescribed by RCW 35.79; and WHEREAS, the Land Use Committee, City Engineer, and Community Development Director have reviewed the petition and recommend moving the petition forward to the full City Council to conduct a public hearing; now therefore, Resolution No. 047-16 Page 2 of 2 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: A public hearing upon said street vacation shall be held in the Robert G. Geiger Council Chambers at City Hall located at 216 Prospect Street, Port Orchard, Washington on Tuesday, May 24, 2016 at 7:00 p.m., at which hearing all persons interested in said street vacation are invited to appear. THAT: The City Clerk is directed to post notices of the hearing in three public places and on the street to be vacated and to mail notices to all owners of any property abutting the portion of street to be vacated, pursuant to RCW 35.79.020. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the Clerk in authentication of such passage this 12th day of April 2016.
