A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING
THE MAYOR TO EXECUTE CONTRACT NO C071-16 WITH BERGER ABAM, INC.
FOR THE TREMONT STREET WIDENING PROJECT - CONSTRUCTION PHASE
(FINAL AD READY PS&E, ENVIRONMENTAL PERMITTING AND CONSTRUCTION
ADMINISTRATION/MANAGEMENT) AND DOCUMENTING ARCHITECTURAL &
ENGINEERING SERVICES PROCUREMENT PROCEDURES
WHEREAS, pursuant to RCW 39.80, the City of Port Orchard's Public Works Department
annually publishes the general Request for Qualifications (RFQ) for professional engineering,
surveying, architecture, structural design and related services for the Professional Services
Roster; and
WHEREAS, on June 3, 2013 the City of Port Orchard transitioned to the MRSC
Consultant Roster database, but still publishes annually the general Request for Qualifications
(RFQ) for the Professional Services Roster; and
WHEREAS, on June 30, 2016, the City of Port Orchard Public Works Department
selected six (6) qualified firms from the City's current MRSC Professional Services Roster
(Exhibit A) for the Sub-Category; Streetscapes Improvements, Constructability Reviews, Federal,
State and Local Agency Permitting, Roadway, Bikeway and Walkway Design, Civil Engineering,
Construction Management, Environmental Engineering, Transit Planning & Design,
Transportation/Traffic, Landscape Planning & Design and Project Management; and
WHEREAS, on July 6, 2016, the City of Port Orchard Public Works Department issued a
Request for Qualifications (RFQ) to the six (6) selected firms for the Tremont Street Widening
Project - Construction Phase (Final Ad Ready PS&E, Environmental Permitting and Construction
Administration/Management); and
WHEREAS, by the July 22, 2016 RFQ deadline, the City of Port Orchard Public Works
Department received two (2) Statement of Qualifications (SOQ), whereby the Selection Panel
(City Staff, WSDOT Staff & Councilmember) reviewed, scored and ranked the two (2) firm's
SOQ's; and
WHEREAS, on August 9, 2016, pursuant to the WSDOT Local Agency Guidelines (LAG)
Manual, the Selection Panel held interviews with two (2) consulting firms, then scored and
ranked the two firms, and then based upon the qualifications received and the interview
process, selected the Berger Abam/Exeltech Project Team for the Project and commenced
immediately with Contract negotiations; and
WHEREAS, on August 18, 2016, the City's Public Works Department received a Proposal
from the Berger Abam/Exeltech Project Team; and

WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State
Auditor's Office, wishes to document their consultant selection process as described above for
this particular contract by Resolution; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: The Port Orchard City Council approves Contract 071-16 with Berger Abam, Inc., for the
Tremont Street Widening Project - Construction Phase (Final Ad Ready PS&E, Environmental
Permitting and Construction Administration/Management) and adopts the "Whereas"
statements contained herein, as findings in support of the City's consultant selection
procurement procedures.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the Clerk in authentication of such passage this 23rd day of August 2016.
