A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, APPROVING
CONTRACT NO. C075-16 WITH THE LAW OFFICE OF THOMAS M. PORS, FOR THE
2016-2017 WATER RIGHTS - LEGAL SERVICES AND DOCUMENTING THE
PROFESSIONAL SERVICES PROCUREMENT PROCEDURES
WHEREAS, pursuant to RCW 39.80, the City of Port Orchard's Public Works Department
annually publishes the general Request for Qualifications (RFQ) for professional engineering,
surveying, architecture, structural design and related services for the Professional Services
Roster; and
WHEREAS, on June 3, 2013 the City of Port Orchard transitioned to the MRSC
Consultant Roster database, but still publishes annually the general Request for Qualifications
(RFQ) for the Professional Services Roster; and
WHEREAS, on August 1, 2016 the City of Port Orchard's Public Works Department,
based on a suggested list from the City Attorney, requested a Statement of Qualifications (SOQ)
from three (3) of the recommended Water Rights Legal firms; and
WHEREAS, by the August 3, 2016 deadline, two (2) SOQ's were received, whereby the
City's Public Works Foreman/Water System Manager and Water Systems Consulting firm (BHC
Engineering), reviewed and rated the SOQ's received and selected the Law Office of Thomas M.
Pors, being determined to be the most qualified professional services consultant; and
WHEREAS, on September 2, 2016 the City verified registration of the selected
consultant on current MRSC Professional Services Roster (see Exhibit A attached) for the Main
Category - Legal Services and Sub-Category - Land Use; and
WHEREAS, on September 8, 2016 a satisfactory Professional Services proposal from the
Law Office of Thomas Pors was submitted to the City; and
WHEREAS, the Port Orchard City Council, at the 2015 recommendation of the State
Auditor's Office, wishes to document their consultant selection process as described above for
this particular contract by Resolution; Now, Therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES
AS FOLLOWS:
THAT: The City Council approves Contract No. C075-16 with the Law Office of
Thomas M. Pors for the 2016-2017 Water Rights - Legal Services and adopts
the "Whereas" statements contained herein, as findings in support of the
City's consultant selection procurement procedures.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by
the City Clerk in authentication of such passage on this 13th day of September 2016.
