11/17/2020 - Minutes City of Port Orchard Utility Committee Meeting Minutes November 17, 2020 at 5:04 PM Utility Committee Members Cindy Lucarelli, Jay Rosapepe and John Clausen met on November 17, 2020 via Zoom Meeting. Also present: Public Works Director/City Engineer Mark Dorsey, Utility Manager Jacki Brown and Community Development Director Nick Bond. 2020 DWSRF Loan Application - Discussion: UM Brown provided Committee members with a brief overview of the current Water System Plan Update status and it’s correlation with the pending 2020 DWSRF Loan Application submittal for the Well #11 100% Design and Construction Project, due to the State Department of Health (DOH) at the end on the month. In general summary, Staff is working diligently to meet the deadline, but is fully aware that given the current status of the Well #11 Project, the application will not score well for this round of funding. A Resolution supporting the Loan Application is scheduled for Council Action at the November 24, 2020 Regular Meeting. It is anticipated that the 2021 DWSRF Application for this same Project will score much higher. No further action required at this time. 580 Zone Water Campus - Update: PWD Dorsey and UM Brown provided Committee members with the updates as follows: 580 Zone 0.97 MG Tank – McCormick Communities, continues to make good progress on the construction of the new water reservoir, with the roof (utilizing the preferred ‘pie-shaped’ framing system, is now installed. To be continued. Well #12 – McCormick Communities LLC continues to be reluctant to commence with the continued development of the well unless water rights guarantees are provided, which continue to prove difficult given the challenges of the Foster Pilot Project (see below.) To be continued. Foster Pilot Program - Update: UM Manager Brown updated Committee members on the current status of the Foster Pilot Project – Joint Legislative Task Force (JLTF.) In general summary, the JLTF met most recently on November 10, 2020 and conferred with Water Rights officials from three (3) nearby States to look at the Project and the progress being (or not being) made. Other than the City of Yelm, who has successfully navigated to Step 3 of the three-step process (being the original Foster participant), the other Foster Pilot Project members at still trying to navigate the uncertainty of the process. The City of Port Orchard is currently 60% through Step 2 and is still dealing with the inaccuracy issues with the USGS Model due to the discovery of the new aquifer found during the drillings of Wells #12 and #13. The City will need to continue with the work efforts being provided by our Water Rights Attorney and our Hydrogeological Team. Substantial additional funding will need to be provided within the 2021-2022 Budget for this required activity. To be continued. Water System Plan 2020/2030 - Update: UM Brown updated Committee members on the current status of the now 2020/2030 Water System Plan (WSP) Update of the currently adopted 2011 WSP, originally proposed to be completed in 2017. All Chapters are now complete and the WSP will be submitted to the State Department of Health (DOH) by the end of the month, therefore being in time for our State DWSRF loan opportunities (see above.) Katy Isaksen is now working on the related Rates/CFC’s Analysis associated with the updated CIP’s for discussion in early 2021. To be continued. Splash Pad - Update: PWD Dorsey and UM Brown provided Committee members with the update as follows: VE Exercise - The retrofit Ad Ready design work is now complete, but the Engineer’s Estimate provided was NOT what was anticipated ($528K). Therefore, Staff has selected a Team to provide Value Engineering to hopefully remove any ‘fluff’ in the design, which will delay the Advertisement of the Project. To be continued. Stormwater Comprehensive Plan (2021) - Update: PWD Dorsey updated Committee members on the consultant selection/procurement status, being that Herrera Environmental Consultants, Inc. was selected via Interviews held on November 16, 2020. Staff will now work with Herrera to develop a viable scope, budget and schedule, with a Contract ready for Council approval in either December 2020 or January 2021. To be continued. Port Orchard / Bremerton Water Service Agreement - Discussion: As a function of the Kitsap County Coordinated Water System Plan (CWSP), UM Brown briefed Committee members on this DOH required task, being that an Agreement between the two Cities and their respective Retail Water Service Areas needs to be formalized via Agreement, scheduled for Council approval on the November 24, 2020 Regular Meeting Agenda. No further action required at this time. Sewer CFC Code Amendments - Discussion: CDD Bond provided Committee members with a brief overview of the concerns by Staff on the current Sanitary Sewer Capital Facility Charge (CFC) Credit language found within POMC 13.04.040. In general summary, the current language does not provide Developer incentive to design and build much needed sanitary sewer utility infrastructure in lieu of paying full CFC’s. Proposed language changes will be provided at a future Council meeting for further discussion. To be continued.
