011-05 - Resolution - Use of Sales Tax FundsRESOLUTION NO. 011-05 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, ESTABLISHING A DIRECTIVE FOR THE USE OF SALES TAX FUNDS COLLECTED BY THE PASSAGE OF THE LAW AND JUSTICE SALES TAX BALLOT MEASURE. WHEREAS, the Washington State Legislature in 2003 recognized and found that local governments in the State of Washington face enormous challenges in the area of criminal justice and public safety, and enacted RCW 82.14.450 for the purpose of allowing general local governments to raise revenue in order to better protect the health and safety of Washington state and its residents; and WHEREAS, the Board of County Commissioners, as the legislative authority for Kitsap County, intends to approve a resolution submitting to county voters a ballot measure authorizing imposition of a sales and use tax of 0.15 percent, and, if authorized by the voters, to enact an ordinance imposing such a tax; and WHEREAS, if the voters approve the Law and Justice Sales Tax Ballot Measure, the City of Port Orchard will receive its per capita share conservatively estimated to be approximately $176,000 annually; and WHEREAS, the City of Port Orchard desires to spend any such tax in accordance with state law and the wishes of the voting public; and WHEREAS, prior to the adoption of this resolution, the City provided notice to the public of the City Council meeting to be held on April 25, 2005, including the title and number of the proposed ballot measure, and members of the City Council and the public were provided with an opportunity to express their support or opposition to the law and justice sales tax ballot measure; now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD HEREBY RESOLVES AS FOLLOWS: THAT in accordance with state law, the revenue collected from this ballot measure will not be used to supplant existing services already provided by the City of Port Orchard and it's police department; and FURTHER THAT the City's share of tax revenue collected from the passage of this sales tax ballot measure shall be used to enhance law enforcement services within the City of Port Orchard. This shall be accomplished through the enhancement of programs designed to help prevent crime, reduce repeat calls for police service at problem locations, combat the illegal use of methamphetamine and its related crimes, and enhance the ability of the police department to work more efficiently; and Resolution No. 011-05 Page 2 of 2 FURTHER THAT in order to meet the desires of the voting public who voted and approved such sales tax measure for the purpose of enhancing public safety, the sales tax revenue shall not be used for any purpose other than as listed herein.
