011-06 - Resolution - Reitre Police K9 Charlie from Police DepartmentRESOLUTION NO. 011-06 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING THE MAYOR TO RETIRE POLICE K9 "CHARLIE" FROM THE PORT ORCHARD POLICE DEPARTMENT AND ENTRUSTING K9 "CHARLIE" TO THE CARE AND OWNERSHIP OF POLICE OFFICER "ELIZABETH DEATHERAGE" WHEREAS, K9 "Charlie/1 has rendered more than eight years of faithful and dedicated service to the City of Port Orchard; and WHEREAS, K9 "Charlie/1 is retiring due to his age; and WHEREAS, his handler, Police Officer Elizabeth Deatherage has offered to provide K9 "Charlie" a permanent retirement home and assume all of the responsibilities accompanying pet ownership; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: K9 "Charlie/1 be retired from active service with the Port Orchard Police Department; and FURTHER THAT: The Mayor is authorized to enter into an agreement transferring care and custody of K9 "Charlie" to Police Officer Elizabeth Deatherage. A copy of the agreement is attached hereto as Exhibit A and incorporated by this reference. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the Clerk in authentication of such passage this 13th day of March, 2006. KIM E. ABEL, MAYOR ATTEST: AGREEMENT THIS AGREEMENT is entered into this 14th day of March, 2006 by and between the City of Port Orchard (the "City'') and Elizabeth Deatherage. WHEREAS, K9 "Charlie" has rendered more than 8 years of faithful and dedicated service to the City of Port Orchard; and WHEREAS, as a result of aqe the City has retired K9 "Charlie" from active service as set forth in Resolution J..t_-06; and WHEREAS, K9 "Charlie's" handler, Officer Elizabeth Deatherage, has offered to provide K9 "Charlie" with a permanent retirement home and assume all of the responsibilities accompanying pet ownership; Now, therefore, the parties agree as follows. 1. The care and custody of K9 "Charlie" shall be and hereby is transferred to his loyal and dedicated handler Officer Elizabeth Deatherage as his true and rightful owner. 2. Officer Elizabeth Deatherage shall henceforth be solely responsible for and shall hold the City of Port Orchard, its elected officials, officers, and employees, harmless from any and all claims, costs, expenses, and liabilities arising from or related to the care and custody of K9 "Charlie" that arise on or after the date of this Agreement.
