001-08 - Resolution - DENIED Comprehensive Plan Amendment for property at Tremont Street East of South Kitsap BoulevardDENIED 1/14/08 RESOLUTION NO. 001-08 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON DENYING A COMPREHENSIVE PLAN AMENDENT FOR CERTAIN PROPERTY LOCATED ON TREMONT STREET EAST OF SOUTH KITSAP BOULEVARD TAX PARCEL NUMBER 342401-4-006-2003 WHEREAS, the property owner, Anne Johnson, submitted an application on September 29, 2006, for a Comprehensive Plan Amendment from High-Density Residential to Commercial on her 0.87-acre property located at 381 Tremont Street under application CA 30-06; and WHEREAS, the City of Port Orchard Planning Commission held a public meeting on November 27, 2007, recommended denial of said petition and has transmitted to the City Council a copy of their Resolution No. 017-07, “ATTACHMENT A"; and WHEREAS, the City of Port Orchard is a community which strives to maintain a high quality of life for families; and WHEREAS, the City seeks to maintain a balance between residential and non-residential land uses through effective land use controls such as land use reclassifications and special use permits; and WHEREAS, the property is subject to the guidelines and requirements of the Tremont Corridor Specific Plan; and WHEREAS, The Council of the City of Port Orchard did hold a Public Hearing on December 10, 2007 to hear testimony for and against the petition and finds and concludes as follows: FINDINGS OF FACT: The Findings of Fact in Planning Commission Resolution 017-07 (Exhibit A) are hereby adopted. CONCLUSION: The proposed land use designation of Commercial is not consistent with the surrounding Comprehensive Plan designations or with the Tremont Corridor Plan. Resolution No. 001-08 Page 2 THE COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES HEREBY RESOLVE AS FOLLOWS: The Comprehensive Plan Amendment petition CA 30-06 is hereby DENIED. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the Clerk in authentication of such passage this 14th day of January, 2008.
