007-08 - Resolution - Date of Public Hearing to Vacate Portion of City Right-of-WayRESOLUTION NO. 007-08 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, FIXING THE DATE OF PUBLIC HEARING ON A PE11110N TO VACATE A PORTION OF CITY RIGHT-OF-WAY ON UNNAMED ALLEYWAY ADJACENT TO SIDNEY AVENUE. LEGAL DESCRIPTION: A 20.00-FOOT WIDE PORTION OF THE PLATTED ALLEY WITHIN BLOCK 8, SWEANY'S SECOND ADDffiON TO SIDNEY, ACCORDING TO PLAT RECORDED IN VOLUME 2 OF PLATS, PAGE 18, RECORDS OF KITSAP COUNTY, WASHINGTON, THE SOUTHEASTERLY LINE OF SAID 20.00-FOOT STRIP DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF LOT 21, BLOCK 8, SAID PLAT OF SWEANY'S SECOND ADDffiON TO SIDNEY, WHICH IS ALSO A POINT ON THE WEST LINE OF SAID ALLEY; THENCE NORTH 11 °02'00" EAST ALONG THE WEST LINE OF SAID ALLEY 51.07 FEET TO THE POINT OF BEGINNING OF THIS LINE; THENCE NORTH 31 °03'53" EAST 40.33 FEET TO THE EAST LINE OF SAID ALLEY AND THE POINT OF TERMINATION OF THIS LINE. WHEREAS, the Petitioners have submitted a petition to vacate a portion of City right-of-way located on Unnamed Alleyway adjacent to Sidney Avenue; and WHEREAS, the Petitioners constitute one hundred percent of the owners of the property abutting the area proposed for vacation; and WHEREAS, the property sought to be vacated is approximately 800 square feet; and WHEREFORE, Petitioners have requested that proceedings be had hereon for the vacation of said area of said right-of-way in the manner prescribed by Chapter 35.79 RCW; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: A Public Hearing on a Petition to vacate a portion of City right-of- way located on Unnamed Alleyway adjacent to Sidney Avenue, as submitted by Chuck Childress, is hereby set for Tuesday, March 11, 2008, at 7:00p.m., in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington.
