042-08 - Resolution - Thirty Day Extension of Interlocal Agreement with PUD No. 1RESOLUTION NO. 042-08 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, REGARDING A THIRTY DAY EXTENSION OF THE INTERLOCAL AGREEMENT BETWEEN PUBLIC UTILITY DISTRICT NO. 1 OF KITSAP COUNTY AND THE CITY OF PORT ORCHARD WHEREAS, on September 23, 2003 the City of Port Orchard entered into a five year Interlocal Agreement with Public Utility District No. 1 of Kitsap County (the PUD) regarding the use of City rights of way for telecommunication services; and WHEREAS, on August 12, 2008, the City Council passed Resolution No. 038-08 stating as a matter of policy that there was no reason to renew the existing Interlocal Agreement because the PUD did not appear to have any plans to use the City's rights of way to provide telecommunication services to the citizens of Port Orchard; and WHEREAS, subsequently, representatives from the PUD have proposed to provide fiber optic builds to designated sites within the City pursuant to an agreed upon schedule and have asked the City to renew the Interlocal Agreement; and WHEREAS, in order to provide the City and the PUD with sufficient time to negotiate and execute an amendment to the original Interlocal Agreement, the parties propose to extend the Interlocal Agreement's termination date by thirty days; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City Council agrees to extend the termination date of the Interlocal Agreement between the City and PUD No. 1 from September 23, 2008 to October 23, 2008. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the Clerk in authentication of such passage this 9th day of September 2008. ATTEST:
