A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING THE CONTRACT BETWEEN THE CITY OF PORT ORCHARD AND
BERGER/ABAM ENGINEERS, INC. AND AUTHORIZING THE MAYOR TO
EXECUTE THE AMENDED CONTRACT (SUPPLEMENTAL AGREEMENT
NUMBER9)
WHEREAS, on August 20, 2005 the City of Port Orchard entered into a Contract with
Berger/Abam Engineering, Inc. regarding the Tremont Street Widening Project; and
WHEREAS, since August 20, 2005 there have been eight (8) contract supplemental
agreements to date, with the current Berger/Abam Engineering, Inc. contract amount being
$738,125.00 with an associated contract Completion Date of May 30, 2010; and
WHEREAS, the total contract amount needs to be amended from $738,125.00 to
$966,362.00 for the cost to complete the redesign at 100% PS&E, 100% R/W Plan and NEPA
approval for "shovel ready" status; now, therefore;
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
HEREBYRESOLVESASFOLLOWS:
THAT: The City Council agrees to amend the contract between the City of Port
Orchard and Berger j Abam Engineering, Inc. by increasing the contract amount
from $738,125.00 to $966,362.00; and
FURTHER THAT: The Mayor is authorized to execute Supplemental
Agreement Number 9 (Exhibit A) with Berger/Abam Engineering, Inc. for the
Tremont Street Widening Project.
PASS ED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested
by the Clerk in authentication of such passage this 9th day of June 2009.

All provisions in the basic agreement remain in effect except as expressly modified by this supplement.
The changes to the agreement a re described as follows:
Section 1, SCOPE OF WORK, is hereby changed to read:
Project administration, data collection, traffic analysis, public involvement, preliminary design 30%, constwct ion
PSE, and right-of-way plans shall be amended as attached in Exhibit A-I

Section IV, TIME FOR BEGINNING AND COMPLETION, is amended to change the number of calendar days for
completion of the work to read :

Section V, PAYMENT, shall be amended as follows :
