Jacoby May 10,2011 May24, 2011 May24, 2011 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, DECLARING THE INTENT OF THE CITY COUNCIL TO ADOPT THE CLASSIFICATION OF NONCHARTER CODE CITY AND TO BE GOVERNED BY THE PROVISIONS OF TITLE 35A, REVISED CODE OF WASHINGTON WHEREAS, the City Council has studied and evaluated the benefits of changing the classification of the City of Port Orchard from a second class incorporated city to a non-charter code city; and WHEREAS, the City Council has determined that it would serve the best interest and general welfare of the City to change the classification of the City to that of a non-charter code city pursuant to the provisions of RCW 35A.o2.030 and to retain the same general plan of government, but to be governed by Chapter 35A.12 RCW (Mayor- Council); and WHEREAS, the City Council held public hearings on May 10, 2011, May 17, 2011 and May 24, 2011 to receive public comment concerning whether to convert to a non- charter code city; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: Section 1. The City Council does hereby declare its intent to adopt for the City of Port Orchard the classification of "non-charter code city." Section 2. The City Council intends (a) to retain the same general plan of government under which it is currently organized, to wit: mayor-council, but to be governed by Chapter 35A.12 RCW of the Optional Municipal Code. Section 3· The City Clerk is hereby authorized and directed to publish this resolution at least once within ten (10) days of the resolution's passage. Section 4· If no timely and sufficient referendum petition has been filed, as is provided for in RCW 35A.02.035, within ninety (90) days of the first publication of this resolution, excluding the date of first publication, the City Council shall by ordinance adopt for the City the classification of "non-charter code city" under the mayor-council form of government.
