027-11 - Resolution - Procedures for Annual Distribution of Hotel/Motel Lodging TaxIntroduced by: Requested by: Drafted by: Introduced: Adopted: RESOLUTION NO. 027-11 Councilmember Childs Councilmember Childs City Attorney August 23, 2011 August 23, 2011 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, CREATING PROCEDURES FOR ANNUAL DISTRIBUTION OF HOTEL/MOTEL LODGING TAX FUNDING WHEREAS, Pursuant to RCW 67.28.1817, the City Council established and created a Lodging Tax Advisory Committee, as codified in Chapter 2.22 of the Port Orchard Municipal Code; and WHEREAS, the City Council has determined that it is in the best interest of the public to create procedures relating to the annual distribution of the Hotel/Motel funding; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City Council hereby approves the following process for annual disbursement of Hotel/Motel Lodging Tax funds: 1) In August of each year, the City Treasurer shall project the following year's Hotel/Motel Lodging Tax funds and shall report the projected numbers to the City Clerk; 2) Annually, the City Clerk shall advertise in the City's official newspaper that the City is accepting applications for use of Hotel/Motel Lodging Tax funds; 3) Applicants shall submit their request for funds to the City Clerk no later than a date predetermined by the Chair of the Lodging Tax Advisory Committee (LTAC); 4) Upon receipt of the submitted applications, the LTAC shall meet to review all applications and make recommendations to the City Council, indicating which applicants should receive funding and their proportionate share; s) The Chair of the LTAC shall work with the City Clerk in preparing a report to the City Council that is based on the LTAC' s recommendation for review at the September Work Study Session; Resolution No. 027-11 Page 2 of 2 6) After review by the City Council at a Work Study Session, the final recommendations shall be brought forward to the next regularly scheduled City Council meeting for action; 7) Upon City Council approval the City Clerk shall notify the applicants, in writing, of the amount of their proportionate share of funding awarded; 8) No later than January 31st annually, the City Treasurer shall review the current year's Hotel/Motel Lodging Tax funds to ascertain if surplus funds remain in the account and shall report that amount to the City Clerk; and 9) Any surplus funding shall be reported by the City Clerk to the LTAC Chair and sections 2-7 above shall apply.
