A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON, REPEALING RESOLUTION NO. 014-11 WHICH
DEClARED THE INTENT OF THE CITY COUNCIL TO ADOPT THE
CLASSIFICATION OF NONCHARTER CODE CITY AND TO BE
GOVERNED BY THE PROVISIONS OF TITLE 35A, REVISED CODE
OF WASHINGTON
WHEREAS, on May 24, 2011 the Port Orchard City Council adopted Resolution
No. 014-11 declaring the intent of the City Council to adopt the classification of
noncharter code city and to be governed by the provisions of Title 35A of the Revised
Code of Washington; and
WHEREAS, the City Council's action took place following several City Council
meetings where the pros and cons of converting to a noncharter code city were
discussed in open session and two public hearings where the public was invited to
comment on the proposed action; and
WHEREAS, a total of four persons spoke at the two public hearings that were
held to receive public comment and none spoke against the proposed reclassification,
although one person spoke in favor of referring the proposal to the voters; and
WHEREAS, because of the paucity of public comment and lack of opposition to
the reclassification proposal, the City Council determined to use a direct resolution
method for adopting the classification of a noncharter code city, subject to a referendum
petition; and
WHEREAS, several hundred qualified electors of the City of Port Orchard have
signed a petition requesting that the issue of whether to convert to a noncharter code
city be referred to the voters; and
WHEREAS, although a final and complete referendum petition has not yet been
submitted to the City, if a legally sufficient referendum petition is received in accordance
with RCW 35A.o2.035, the City will be required to refer the issue to a special election to
be held February 7, 2012 at significant cost to the City of as much as $45,000; and

WHEREAS, the City Council has been motivated by a desire to pursue an open,
transparent, and cost effective process for accomplishing the reclassification of the City
to a noncharter code city and has never been opposed to referring this question to a vote
of the citizens; now, therefore;
THE CI1Y COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, HEREBY RESOLVES AS FOLLOWS:
THAT: Resolution No. 014-11 is repealed in its entirety so that the City
Council may reconsider a process and timeline for submitting to the
voters the question of whether to convert to a noncharter code city.
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the City Clerk in authentication of such passage this 23rd day of August 2011.
