010-12 - Resolution - Application for Funding Assistance for Aquatic Lands EnhancementIntroduced by: Development Director Requested by: Development Director Drafted by: Development Director Reviewed by: Gregory A Jacoby Introduced: April 24, 2012 Adopted: April 24, 2012 RESOLUTION NO. 010-12 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AUTHORIZING APPLICATION FOR FUNDING ASSISTANCE FOR AN AQUATIC LANDS ENHANCEMENT ACCOUNT (ALEA) PROGRAM PROJECT TO THE RECREATION AND CONSERVATION OFFICE (RCO) AS PROVIDED IN RCW 79.90.245 AND SUBSEQUENT LEGISLATIVE ACTION. WHEREAS, our organization has approved a comprehensive plan that includes this Bay Street Pedestrian Path project area; and WHEREAS, under the provisions of ALEA, state funding assistance is requested to aid in financing the cost of Bay Street Pedestrian Path land acquisition and/ or facility development; and WHEREAS, our organization considers it in the best public interest to complete the Bay Street Pedestrian Path land acquisition and/ or development project described in the application; now, therefore; THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: 1. The Mayor be authorized to make formal application to the Recreation and Conservation Office for Bay Street Pedestrian Path funding assistance; 2. Any fund assistance received be used for implementation of the project referenced above; 3. Our organization hereby certifies that its share of project funding is committed and will be derived from local match funds, Capital Budget Main Street Funds, and REETfunds; 4· We acknowledge that we are responsible for supporting all non-cash commitments to this project should they not materialize; s. We are aware that the grant, if approved will be paid on a reimbursement basis. This means we may only request payment after eligible and allowable costs have already been paid and remitted to our vendors; 6. We acknowledge that any property acquired or facility developed with financial aid from the Recreation and Conservation Funding Board (RCFB) must be placed in use for the funded purpose, and be retained in such use in perpetuity unless otherwise provided and agreed to by our organization and RCFB; Resolution No. 010-12 Page 2 of2 7. This resolution becomes part of a formal application to the Recreation and Conservation Office; and 8. We provided appropriate opportunity for public comment on this application. PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and attested by the City Clerk of authentication of such passage this 24th day of April 2012.
