021-12 - Resolution - Provision of Sewer Service within #6/McCormick Woods Urban Growth AreasIntroduced by: Public Works Director Requested by: Kitsap County Drafted by: City Attorney Reviewed by: City Attorney Introduced: August 14, 2012 Adopted: August 14, 2012 RESOLUTION NO. 021-12 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, AFFIRMING THE PROVISION OF SEWER SERVICE WITHIN THE PORT ORCHARD AND ULID #6/MCCORMICK WOODS URBAN GROWTH AREAS PURSUANT TO THE CITY'S ADOPTED CAPITAL IMPROVEMENT PROGRAM WHEREAS, in 2006, Kitsap County adopted a 10-Year update to its comprehensive land use plan. This update up zoned and expanded many of the Urban Growth Areas (UGAs), including the associated Port Orchard and ULID #6/McCormick Woods UGAs; and WHEREAS, in August 2011, the Central Puget Sound Growth Management Hearings Board remanded the 2006 plan to the County to resolve the sizing and composition of certain UGAs; and WHEREAS, in response the County conducted a supplemental environmental review of land use alternatives that included full capital facilities analysis of wastewater needs for the UGAs. This information can be found in the County's Draft and Final 2012 Capital Facilities Plan and associated environmental analysis; and WHEREAS, as part of the capital facility plan requirements, Kitsap County is seeking assurances from relevant service providers that sanitary sewer service will be adequate and available within the 20-year planning period; and WHEREAS, the City of Port Orchard is the wastewater service provider for the ULID #6/McCormick Woods UGA; and WHEREAS, in October 2010 via Ordinance 020-10 & Ordinance 033-09 the City of Port Orchard adopted its 2009 Capital Improvement Program (CIP) which sets forth a plan for the provision of wastewater services to accommodate the 2025 growth population for the City and associated UGAs; and WHEREAS, the City generally relies upon private funding such as developer extensions, local improvements districts or other mechanisms to finance the extension of sewer collection systems outside of the City boundaries, such extensions are not shown in the City's CIP, but rather, are added once a binding commitment is finalized .. Resolution No. 021-12 Page 2 of 2 WHEREAS, in April 2012, the City of Port Orchard annexed the entire ULID #6/McCormick Woods UGA except some properties that contain public facilities, as well as annexed a large portion of the Port Orchard UGA commonly known as the Bethel Corridor; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: The City of Port Orchard currently provides sanitary sewer service within portions of the Port Orchard UGA and the entire UGA known ULID #6/McCormick. THAT: In accordance with the City's 2009 Capital Improvement Program (CIP) and the current surplus capacity of the wastewater treatment plant which is jointly managed with West Sound Utility district, the City of Port Orchard affirms that at this time it has both the capacity and/ or the ability to serve its service area of the Port Orchard UGA and the entire ULID #6/McCormick UGA with public sanitary sewer service as shown in the Preferred Alternative of the Kitsap County Comprehensive Plan update.
