008-13 - Resolution - Repayment to RCO for Blackjack Wilderness Trail ProjectIntroduced by: Acting Development Director Requested by: Finance Committee Drafted by: City Treasurer Introduced: April 23, 2013 Adopted: April23, 2013 RESOLUTION NO. oo8-13 A RESOLUTION OF THE CITY OF PORT ORCHARD, WASHINGTON, DIRECfiNG THE REPAYMENT OF $10,090.94 TO THE RECREATION AND CONSEVATION OFFICE FOR GRANT FUNDS DISBURSED FOR THE BLACKJACK WILDERNESSTRAJLPROJECT WHEREAS, the City adopted Resolution No. 041-09 supporting grant applications for the Blackjack Creek Wilderness Trail seeking Federal and State funding for trails through the Land and Water Conservation Fund and the National Recreation Trails Program; and WHEREAS, the City adopted Resolution No. 047-09 with specific language which was submitted with an application to the Recreation and Conservation Office (RCO) in order to secure grant funding; and WHEREAS, the Recreation and Conservation Funding Board (RCFB) awarded funding for the Blackjack Creek/Mosquito Trail Connection, RCO #09-1167C, and a project agreement was executed on August 11, 2010, for management and construction related expenses, with the City subsequently embarking on the planning, right-of-way acquisition, development, and construction of the Blackjack Creek Wilderness Trail; and WHEREAS, the City encountered right-of-way acquisition challenges that it could not overcome resulting in insufficient progress, in addition to ground disturbing actives that occurred at the site prior to RCO staff authorization of such activities; and WHEREAS, a letter dated March 13, 2013, from Kaleen Cottingham, Director of Recreation and Conservation Office, terminated the grant Project Agreement and RCO's funding obligation based upon insufficient progress and ground disturbing activities requiring repayment of grant funds disbursed on or before April30, 2013; and WHEREAS, it is the recommendation of the Council Finance Committee to not appeal the decision of the RCO; and WHEREAS, the City expended $24,756.71 from the Cumulative Reserve for Municipal Facilities Fund No. 302 with $10,090.94 reimbursed by the RCO #og-1167C grant; now, therefore, Resolution No. 008-13 Page 2 of2 THE CTIY COUNCIL OF . THE CTIY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: THAT: the City Treasurer is directed to repay $10,090.94 to the Recreation Conservation Office from the Cumulative Reserve for Municipal Facilities Fund No. 302 budgeted for Blackjack Wilderness Trail construction.
