RESOLUTION NO. 016-13
A RESOLUTION OF THE CITY OF PORT ORCHARD,
WASHINGTON, DECLARING THE CITY COUNCIL'S INTENT
TO SUBMIT TO THE VOTERS OF THE CITY, AT THE GENERAL
ELECTION ON NOVEMBER 5, 2013, A SINGLE BALLOT
MEASURE AS TO WHETHER THE CITY SHOULD RECLASSIFY
AS A NONCHARTER CODE CITY UNDER CHAPTER 35A.02
RCW AND ALSO ADOPT THE COUNCIL-MANAGER PLAN OF
GOVERNMENT AND ABANDON THE COUNCIL-MAYOR PLAN
OF GOVERNMENT
WHEREAS, the City of Port Orchard is a second class city organized and
operating under Chapter 35.23 RCW and the Council-Mayor plan of government; and
WHEREAS, Chapter 35A.02 RCW authorizes and sets forth a procedure by
which an incorporated municipality can change its classification to a noncharter code
city and change its plan of government; and
WHEREAS, the City Council has determined that it would serve the best
interests and general welfare of the City to submit a single ballot measure to the voters
of the City as to whether to change the classification of the City to that of a noncharter
code city under Chapter 35A02 RCW and whether to adopt the council-manager plan of
government and abandon the council-mayor plan of government; and
WHEREAS, the City Council desires that the ballot measure be submitted to the
voters of the City at the general election to be held on November 5, 2013; now,
therefore;
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD,
WASHINGTON, HEREBY RESOLVES AS FOllOWS:
Section 1. In accordance with RCW 35A.o2.070 and RCW 29A.o4.330, the City
Council hereby requests and calls for the Kitsap County Auditor to submit the following
proposition at the November 5, 2013 general election to the voters of the City of Port

Orchard in the form of a ballot measure prepared by the City Attorney to read
substantially as follows :
PROPOSITION
AUTHORIZATION TO CHANGE THE CLASSIFICATION
OF THE CITI TO A NON CHARTER CODE CITI AND
ADOPT THE COUNCIL-MANAGER PLAN OF
GOVERNMENT WITHIN THE CITI OF PORT ORCHARD
Shall the City of Port Orchard change the classification of the City from a
second class city to a noncharter code city operating under Chapter 35A.02
RCW and adopt the council-manager plan of government and abandon the
council-mayor plan of government?
For reclassification to a noncharter
code city and adoption of a council-

Section 2. The City Clerk is authorized and directed to file a certified copy of
this Resolution with the Kitsap County Auditor on or before July 24, 2013 .
PASSED by the City Council of the City of Port Orchard, SIGNED by the Mayor and
attested by the City Clerk in authentication of such passage this 9th day of July 2013.
