008-14 - Ordinance - Chapter 1.20 City Flag PoliciesIntroduced by: City Clerk Requested by: City Council Drafted by: City Clerk Reviewed by: City Attorney Introduced: May 27, 2014 Adopted: June io, 2014 ORDINANCE NO. 008-14 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE PORT ORCHARD MUNICIPAL CODE BY ADDING CHAPTER 1.2o ENTITLED "CITY FLAG POLICIES" WHEREAS, in response to a request from the Association of Washington Cities in August of 2oio, former Port Orchard Mayor Coppola facilitated the development and creation of an official flag for the City of Port Orchard to carry in the parade of cities; and WHEREAS, the City of Port Orchard Flag was developed utilizing the City's logo, consisting of a picture of City Hall with a blue background; and WHEREAS, use of the City of Port Orchard Flag has generated interest from citizens wanting to publicly display the Flag; and WHEREAS, the Port Orchard City Council believes a formal policy governing the use and display of the City Flag is appropriate and desires to adopt a set of policies governing such activities; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION i. The Port Orchard Municipal Code is hereby amended by the addition of Chapter 1.20 "City Flag Policies", which shall read as follows: Chapter 1.20 CITY FLAG POLICIES Sections: 1.20.010 Purpose. 1.20.02o Definitions. 1.20.03o Display policy. 1.20.040 Purchase of Flag. Ordinance No.008-14 Page 2 of 3 1.20.010 Purpose. The city has adopted an official flag for the city of Port Orchard. The city wishes to make this flag available to all citizens and agencies who wish to fly the flag at their homes or places of business. The flag may also be used as a promotional tool to attract visitors and encourage tourism as deemed appropriate by the mayor and/or city council. The purpose of this Chapter is to set guidelines to ensure the flag will be used and displayed appropriately. 1.20.02o Definitions. "Port Orchard Flag" shall mean the flag adopted by the city council as the official flag of the city of Port Orchard. 1.20.03o Display policy. Use of the Port Orchard Flag by the city shall conform to the following conditions: (1) The Port Orchard Flag should be used and treated in a similar fashion to all flags. (2) The Port Orchard Flag shall be in a lower priority position to national flags, such as the American, as well as any state flags. 1.20.040 Purchase of Flag. The city may make the flag available to any citizen requesting it at the cost to the city for reproduction, plus a twenty percent (2o%) handling fee. Any individual wishing to purchase a Port Orchard Flag shall make a request for purchase to the City Clerk's office. SECTION 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 3. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law. ORDINANCE NO. 008-14 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE PORT ORCHARD MUNICIPAL CODE BY ADDING CHAPTER 1.2o ENTITLED "CITY FLAG POLICIES" Copies of Ordinance No. 008-14 are available for review at the office of the City Clerk of the City of Port Orchard.
