Martin Reviewed by: City Attorney Introduced: March 26, 2013 Adopted: March 26, 2013 ORDINANCE NO. oo6-13 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 3.04 BY ABOLISHING THE PAYROLLS FUND AND CLAIMS FUND FOR THE CITY OF PORT ORCHARD AND REPEALING ORDINANCE NO. 722 WHEREAS, pursuant to Ordinance No. 722, the city established a Payrolls Fund and Claims Fund on November 26,1963 into which monies where placed for the paying of employee salaries and wages and payment of claims against the city for any purpose allowing warrants to be drawn and cashed; and WHEREAS, the city adapted to paying claims and other obligations by check beginning on January 1, 2013 as authorized in Ordinance No. 023-12; and WHEREAS, certain claims and obligations paid using warrants remained outstanding until February 7, 2013 necessitating the use of the Payrolls Fund and Claims Fund until that date; and WHEREAS, it is not longer necessary or prudent to continue the Payrolls and Claims Fund, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON.) DO ORDAIN AS FOLLOWS: SECTION 1. Port Orchard Municipal Code section 3.04.030 "Payrolls fund created" is deleted in its entirety. SECTION 2. Port Orchard Municipal Code section 3.04.040 "Claims fund created" is deleted in its entirety. SECTION 3. REPEALER. Ordinance No. 722 enacted November 26, 1963 is hereby repealed in its entirety. SECTION 4. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or Ordinance No.006-13 Page 2 of 2 unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 5. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
