009-12 - Ordinance - Amending the 2012 BudgetIntroduced by: City Treasurer Requested by: Finance Committee Drafted by: City Treasurer First Reading: May 22, 2012 Second Reading: June 12, 2012 Adopted: June 12, 2012 ORDINANCE NO. 009-12 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE BUDGET FOR THE YEAR 2012 AS ADOPTED BY ORDINANCE NO. 021-11 TO RECOGNIZE EXPENDITURES AND REVENUE NOT ANTICIPATED AT THE TIME OF THE ADOPTION OF THE 2012 BUDGET WHEREAS, the City of Port Orchard adopted its 2012 Budget in Ordinance No. 021-11; and WHEREAS, the City desires to keep current on budget amendments; and WHEREAS, it is necessary to make adjustments to accounts and/or funds by means of appropriation adjustments that could not have been anticipated at the time of passage of the 2012 Budget, as provided in RCW 35.33•ogi and RCW 35.33.121; and WHEREAS, planned expenditure items in the 2011 budget were delayed until 2012, and certain projects discussed during the budget process were approved following the adoption of Ordinance No. 021-11, and the April 13, 2012 Bethel Corridor North annexation results in revenues and expenditures that the City desires to include as Supplement Budget amendment items to meet public service levels; and WHEREAS, the City Treasurer received the Dimensional Audio invoice for audio upgrades to the Council Chamber after 2011 year-end resulting in a 2012 expenditure of $18,970 to be reimbursement from the Cumulative Reserve for Municipal Facilities Fund No. 302 to the Current Expense Fund No. oo1; and WHEREAS, the Interlocal Agreement dated November 14, 20o1 between Kitsap County and the City concerning revenue sharing upon annexation requires a sales tax revenue sharing Current Expense Fund No. oo1 payment of $258,629 set aside and budgeted in 2011 but not reconciled and invoiced by the County until 2012; and WHEREAS, paving projects contemplated in the 2012 budget experienced unforeseen challenges caused by poor subsurface resulting in an additional $50,000 allocated to the projects from Cumulative Reserve for Municipal Facilities Fund No. 302 to the City Street Fund 002; and Ordinance No.009-12 Paee 2 of a WHEREAS, Public Works has identified the need to mitigate water quality issues in Well No. 9 to meet the City's priority of ensuring safe potable water an additional $1,000,00o is budgeted $700,000 from Cumulative Reserve for Water Sewer Fund No. 403 and $300,000 from Water Sewer Utility No. 401; and WHEREAS, the City wishes to move forward with the replacement of the McCormick Woods Septic Tank Effluent Pumping system and the City made provisions in its October 2010 rate increase to address the capital improvement an additional $208,000, is budgeted from Water Sewer Utility Fund No 401; and WHEREAS, the City passed Ordinance No, 022-11 that established a Storm Drainage Equipment Replacement Fund No. 422 to be funded from the Storm Drainage Utility Fund No. 421, necessitating a $125,000 transfer from Fund No. 421 into Fund No. 422; and WHEREAS, the City has accounted for the McCormick Woods Impact Fees in Current Expense Fund No. 001 and Title 16 Port Orchard Municipal Code directs their deposit to the Impact Mitigation Fee Fund referenced as the Transportation Impact Fee Fund No. ui, resulting in $612,00o being transferred from Fund No. 001 to Fund No, ii1; and WHEREAS, the City adopted Ordinance No. 027-11 establishing a water rate increase for the Water Sewer Utility Fund No. 401 an additional $197,000 is addedto water sales revenue; and WHEREAS, the Water Sewer Utility Fund No. 401 is required to pay water utility tax to the Current Expense Fund No 001, $9,850 is added to Current Expense Fund No. 001 Utility Tax Water category; and WHEREAS, Public Works has identified that it is necessary to update the Developers Handbook and that the Public Works Department does not have the internal resources to complete this task an additional $19,00o is added to outsource this project. The cost being shared between City Street Fund No. 002 $2,280, Water Sewer Utility Fund No. 401$11,780, and Storm Drainage Utility Fund No. 421$4,940; and WHEREAS, the Council Finance Committee at its April 4, 2012 meeting directed that the Supplemental to the 2012 Budget based upon the Bethel Corridor North Annexation finance plan be placed on the agenda of the May 15, 2012 Council Work Study Session for discussion; and Ordinance No.009-12 Page � of 4 WHEREAS, it was the consensus of the Council following discussion on May 15, 2012 to include the Supplemental to the 2012 Budget into the upcoming Ordinance amending the budget for the year 2012, resulting in budget adjustments of $476,548; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION i. The 2012 Budget is amended to reflect the following: (1) Estimated Revenue adjustments to the 2012 Budget From All Sources: $2,448,997 (2) Estimated Appropriations adjustments: Current Expense Fund No. ooi $534,875 City Street Fund No. 002 $241,031 Criminal Justice Fund No 103 $7,277 Transportation Impact Fund No. 111 $612,000 Water Sewer Utility Fund No. 401 $897,000 Storm Drainage Fund No. 421 $31,814 Storm Drainage Equipment Reserve Fund No. 422 $125,000 SECTION 2. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION q. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
