001-11 - Ordinance - Amending POMC 5.56 Permitting of TaxicabsIntroduced by: City Clerk Requested by: City Clerk Drafted by: City Clerk Reviewed by: City Attorney Introduced: January tt, 2011 Adopted: January u, 2011 ORDINANCE NO. ooi-ii AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING CHAPTER 5.56 OF THE PORT ORCHARD MUNICIPAL CODE AS IT RELATES TO THE PERMITTING OF TAXICABS WHEREAS, Port Orchard Municipal Code Chapter 5.56 regulates taxicabs operating within City limits; and WHEREAS, the City Clerk and Chief of Police work together to administer taxicab licenses and they have recommended that the municipal code be amended in order to ensure compliance by the various taxicab companies operating within City limits; and WHEREAS, Staff has determined that taxicab companies and operators are failing to renew the appropriate licenses to operate within the City limits and it has become increasingly difficult for law enforcement to determine which cabs are licensed to operate within the City limits; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, HEREBY RESOLVES AS FOLLOWS: SECTION i. Port Orchard Municipal Code Chapter 5.56 Taxicabs is hereby amended as follows: Sections: 5.56.oio Supervisory duties of officials. 5.56.020 Taxicab owner and for -hire vehicle owner responsibilities. 5.56.030 Vehicle permit required — Application. 5.56.040 Mechanical requirements of vehicle. 5.56.050 Vehicle permit. 5.56.o6o Name of owner displayed on vehicle. 5.56.070 Vehicle permit fee. 5.56.o8o Maintenance of vehicles — Inspections. 5.56.ogo Driver's license required — Qualifications of drivers. 5.56.1oo For -hire driver -passenger relations standards. 5.56.iio Fingerprints and photographs of driver applicant. 5.56.120 Issuance of driver's license. 5.56.130 Renewal of driver's license. 5.56.140 Driver's license fee — Nontransferability of license. 5.56.150 Driver's license records kept by clerk. 5.56.16o Driver to furnish receipt on demand. 5.56.170 Penalty. Ordinance No. ooi-u Page 2 of 3 5.56.i8o Revocation or suspension of license — Procedure. SECTION 2. Port Orchard Municipal Code Section 5.56.030 is hereby amended as follows: 5.56.030 Vehicle permit required — Application. No taxicab shall ply or be operated upon the streets of the city without first obtaining a permit to do so. The permit shall be issued by the clerk or designee. The permit if issued shall be for the calendar year and shall be effective for such period of time unless sooner suspended or revoked as hereinafter provided. Applications for permits for taxicabs shall be made by the owner thereof upon blank forms to be furnished by the clerk. The applications shall contain the full name and address of the owner, the type of the vehicle, and its passenger - carrying capacity. SECTION 3. Port Orchard Municipal Code Section 5.56.040 is hereby amended to read as follows: 5.56.040 Mechanical requirements of vehicle. No taxicab shall be issued a permit unless there is installed therein a taximeter capable of mechanically calculating the rates for hire; provided, that the council may, for good cause shown, waive the requirement for installation of the taximeters. SECTION 4. Port Orchard Municipal Code Section 5.56.o5o is hereby amended as follows: 5.56.050 Vehicle permit. (1) Upon completion of the appropriate form and payment of the permit fee set forth below, the clerk shall deliver to the owner of the vehicle a vehicle permit of such size and form as may be prescribed the clerk. (2) The vehicle permit shall be displayed on the rear bumper of the vehicle to the left of the license plate. (3) Failure to display the vehicle permit in the manner prescribed in subsection (2) of this section shall result in the penalty as set forth in POMC 5.56.170(4). SECTION 5. Port Orchard Municipal Code Section 5.56.o6o is hereby amended to read as follows: 5.56.o6o Name of owner displayed on vehicle. Every taxicab issued a permit under the provisions of this chapter shall have the name of its owner plainly painted in letters at least two inches in height in a conspicuous place on each side of the vehicle. Ordinance No. ooi-1i Page 3 of 3 SECTION 6. Port Orchard Municipal Code Section 5.56.070 is hereby amended to read as follows: 5.56.070 Vehicle permit fee. The permit fee shall be $20.00 per annum for each taxicab issued a permit. In the case of permits issued on or after July ist of each year, one-half only of the above fee shall be paid. Such permit shall not be transferable. SECTION 7. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law. SECTION 8. Each and every provision of this Ordinance shall be deemed severable. If any provision of this Ordinance should be deemed to be unconstitutional or otherwise contrary to law by a court of competent jurisdiction, then it shall not affect the validity of the remaining sections so long as the intent of the Ordinance can be fulfilled without the illegal section.
