005-11 - Ordinance - Amending POMC Chapter 10.04 by Adopting Certain Traffic Regulations by ReferenceIntroduced by: Police Chief Requested by: Police Chief Drafted by: Police Chief Reviewed by: City Attorney Introduced: April 26, 2011 Adopted: April 26, 2011 ORDINANCE NO.005-11 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 10.04 BY ADOPTING CERTAIN TRAFFIC REGULATIONS BY REFERENCE WHEREAS, the City has adopted the Washington Model Traffic Ordinance and incorporated it into the Port Orchard Municipal Code by reference; and WHEREAS, the City has not reviewed or updated Chapter 10.04 POMC since 1994; and WHEREAS, the City Council wishes to ensure that this code is updated to reflect the currently adopted Washington Administrative Code and to remove superfluous language; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Section 10.04.010 of the Port Orchard Municipal Code is amended to read as follows: 10.04.010 Adoption by reference. The "Washington Model Traffic Ordinance," Chapter 308-330 WAC, with any amendments thereto, is adopted by reference as the traffic ordinance of the city of Port Orchard as if set forth in full in this chapter. SECTION 2. Section 10.04.020 of the Port Orchard Municipal Code is amended to read as follows: 10.04.02o Additional provisions adopted. The following sections of Washington Administrative Code (WAC) and the Revised Code of Washington (RCW) are adopted by reference, with any amendments thereto, and are included in the traffic ordinance of this city as if fully set forth in this chapter: RCW 46.20.710. SECTION 3. Section 10.04.030 of the Port Orchard Municipal Code is amended to read as follows: 10.04.030 Sections not adopted. The following sections of the Washington Model Traffic Ordinance are not adopted by reference and are expressly deleted: WAC 3o8-330-250, 308-330-275, 308-330-500, 308-330-505, 308-330-510, 308-330-515, 308-330-520, 308-330-525, 308-330-530, Ordinance No. 005-11 Page 2 of 2 3o8-330-535, 3o8-330-540, 308-33o-825, RCW 46.44.090, 46.44.091, 46.44.092, 46.44.093, 46.44.095, 46.44.o96, 46.44.120, 46.44.130, 46.44.140. SECTION 4. If any section, sentence, clause or phrase of this ordinance should be held to be invalid or unconstitutional by a court of competent jurisdiction, such invalidity or unconstitutionality shall not affect the validity of constitutionality of any other section, sentence, clause or phrase of this ordinance. SECTION 5. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
