AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON, AMENDING SECTION io.88.oio OF THE
MUNICIPAL CODE TO REFLECT THE RECODIFICATION BY THE
LEGISLATURE OF CERTAIN BOATING REGULATIONS
WHEREAS, Chapter 88.02 RCW contain provisions for the regulation of vessels; and
WHEREAS, Washington State Legislature reorganized statutes containing vessel
registration and title provisions, Chapter 161, 2010 Laws (SB 6379) effective Juy 1, 2011; and
WHEREAS, the City of Port Orchard desires to be able to enforce these regulations in
Port Orchard Municipal Court; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. Section 10.88.010 of the Port Orchard Municipal Code is amended to read
as follows:
10.88.010 Adoption by reference. The following sections of the Revised Code of Washington
(RCW) and the Washington Administrative Code (WAC), and any amendments thereto, are
adopted by reference, and are included in this chapter as if fully set forth herein: RCW
79A.6o.010, 79A.6o.020, 79A.6o.030, 79A.6o.040, 79A.6o.080, 79A.6o.120, 79A.6o.130,
79A.6o.140, 79A.6o.150, 79A6o.160, 79A.6o.170, 79A.6o.180, 79A.6o.190, 79A.6o.200, 88.02.
310, 88.02.550, 88.02. 790, 88.02. 570, 88.02. 730, 88.02. 340, 88.02.380, 88.02.740, 88.02.
400, 88.02.760, 88.28.050, WAC 308-93-140, 3o8-93-145, 352-60-010, 352-60-020, 352-60-

SECTION 2. Severability. If any section, subsection, paragraph, sentence, clause, or
phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision
shall not affect the validity of the remaining parts of this ordinance.

SECTION 3. This ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of
the entire ordinance, as authorized by State Law.
