ORDINANCE NO. 015-11
AN ORDINANCE OF THE CITY OF PORT ORCHARD,
WASHINGTON REPEALING ORDINANCE NO. n61, AS CODIFIED
AT CHAPTER 9.53 OF THE PORT ORCHARD MUNICIPAL CODE
"DETENTION AND INCARCERATION"
WHEREAS, in 1981 the City of Port Orchard adopted Chapter 9.53 POMC which
codified an agreement between the City of Port Orchard and Kitsap County for the
incarceration of persons arrested; and
WHEREAS, since the adoption of this ordinance, the City has entered into other
agreements with the County and other municipal entities for the incarceration of persons
arrested for misdemeanor and gross -misdemeanor offenses within the City; and
WHEREAS, the provisions of Chapter 9.53 POMC are in conflict or duplicative of
the terms of these other agreements and the City Council desires to eliminate any conflict or
confusion; and
WHEREAS, in light of the fact that contract terms are re -negotiated at the
expiration of each agreement, the City Council no longer finds it necessary or appropriate to
codify the terms of said agreements; now, therefore,
THE CITY COUNCIL OF THE CTI'Y OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
SECTION 1. Ordinance No. 1161, as codified at Chapter 9.53 of the Port Orchard
Municipal Code, is hereby repealed in its entirety.
SECTION 2. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be published
in lieu of the entire ordinance, as authorized by State Law.
