AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 5.6o SAFE
AND SANE FIREWORKS SECTION5.6o.040 PERTAINING TO THE
NUMBER OF LICENSES TO BE ISSUED ANNUALLY
WHEREAS, Port Orchard Municipal Code (POMC) Chapter 5.6o.040 provides that
only seven licenses shall be issued annually in the city; and
WHEREAS, the proposed changes are to eliminate the number of licenses issued
annually in the City; and
WHEREAS, the proposed changes will allow those fireworks providers to receive a
permit within the City limits so long as they comply with all state and local laws; now
therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON,
DO ORDAIN AS FOLLOWS:
Section i. Port Orchard Municipal Code Section 5.6o.040 is hereby amended to
read as follows:
5.60.04o Number of permits and stands.
Fourth of July Holiday Period. Each permittee shall be issued a
fireworks permit annually and is entitled to only one retail outlet.
Section2. Each and every provision of this Ordinance shall be deemed
severable. In the event that any portion of this Ordinance is determined by final order of
a court of competent jurisdiction to be void or unenforceable, such determination shall
not affect the validity of the remaining provisions thereof provided the intent of this
Ordinance can still be furthered without the invalid provision.

Section.g. This ordinance shall be in full force and effect five (5) days after
posting and publication as required by law. A summary of this Ordinance may be
published in lieu of the entire ordinance, as authorized by State Law.
PASSED by the City Council of the City of Port Orchard, APPROVED by the Mayor
and attested by the Clerk in authentication of such passage this 9th day of June 2009.
