AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON
AMENDING THE BUDGET FOR THE YEAR 2008, ORDERING
APPROPRIATION OF FUNDS AND AUTHORIZING A BUDGETARY
TRANSFER FROM THE CUMULATIVE RESERVE FOR MUNICIPAL FACILITIES
FUND TO THE CURRENT EXPENSE FUND
WHEREAS, the City of Port Orchard adopted its 2008 Budget in Ordinance No. 042-07; and
WHEREAS, the City desires to keep current on budget amendments and it is necessary
from time to time to make adjustments to accounts and/or funds by means of appropriation adjustments
that could not have been anticipated at the time of passage of the 2008 Budget, as provided for in RCW
35.33.091; and
WHEREAS, the City's Capital Facilities Element of the Comprehensive Plan includes a
provision relating to franchise utility services; and
WHEREAS, the City Council committed in the 2007 and 2008 budget to pay for the
undergrounding of franchise utilities in Bay St. from property taxes in the Current Expense Fund; and
WHEREAS, at the April 22, 2008 meeting the City Council awarded contract 004-08 in the
amount of $46,800 (plus sales tax) for the Orchard Avenue portion and contract 005-08 in the amount of
$92,500 (plus sales tax) for the Frederick Avenue portion; and
WHEREAS, at the May 13, 2008 meeting the City Council awarded contract 006-08 in an
amount not to exceed $180,000 (includes sales tax) for the Sidney Avenue portion to complete the utilities
undergrounding; and
WHEREAS, the total contract amount for the undergrounding of franchise utilities in Bay
Street exceeds the 2008 budget appropriation; and
WHEREAS, the source of revenue for the additional appropriation will come from the
Cumulative Reserve for Municipal Facilities Fund to the Current Expense Fund; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
Section 1. That the 2008 Budget be amended to reflect the following:
(a) The appropriation for the undergrounding of utilities in Bay St. from the
Cumulative Reserve for Municipal Facilities Fund: $300,000.00.
(b) The transfer of revenue in the Cumulative Reserve for Municipal Facilities Fund to
the Current Expense Fund: up to $300,000.00.
(c) The appropriation to pay for the additional costs of undergrounding of utilities in
Bay St. from the Current Expense Fund: $300,000.00.
Section 2. This ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this ordinance may be published in lieu of the entire
Ordinance No. 015-08
