042-08 - Ordinance - Adopting the 10-Year Update to the Comp PlanORDINANCE NO. 042-08 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, ADOPTING THE 10-YEAR UPDATE OF THE PORT ORCHARD COMPREHENSIVE PLAN PURSUANT TO THE STATE OF WASHINGTON'S GROWTH MANAGEMENT ACT WHEREAS, with the passage of the Washington State Growth Management Act in 1990 (GMA), Chapter 36.70A RCW, developing communities are required to adopt a comprehensive plan that outlines strategies to accommodate the needs of a growing population; and WHEREAS, in June 1995, the City Council adopted a Comprehensive Plan for the City of Port Orchard and its urban growth area pursuant to the requirements set forth in the GMA; and WHEREAS, State law requires that each city planning under the GMA must periodically review, and, if needed, revise its comprehensive plan and development regulations to ensure compliance with the GMA; and WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and procedures of the Growth Management Act; and WHEREAS, pursuant to the GMA, non -emergency amendments to the Comprehensive Plan can be considered no more than once each year; and WHEREAS, various amendments have been submitted by private individuals and the City; and WHEREAS, the City of Port Orchard has actively sought citizen input utilizing several public informational media, including a City sponsored Port Orchard Plan website and survey, multiple stakeholder and subcommittee focus group meetings, comment cards and land use requests, public display boards, flyers, press releases and newspaper articles, Scoping and Vision public meetings, local agency meetings, public announcements, flyers inserted to sewer and water bills, in addition to the regularly noticed public meetings and public hearings; and WHEREAS, On March 17, 2008, following proper notice, the Planning Commission held a Open House / Kick Off public workshop for the Port Orchard Comprehensive Plan 10-Year Update, including project schedules, proposed sub -committees, plan elements, and public involvement plan; and WHEREAS, On April 7, 2008, the Tremont Corridor sub -committee conducted a public meeting to discuss the elements of the district and proposed district boundary recommendations to the Planning Commission; and Ordinance No, 042-08 Page 2 of 5 WHEREAS, On April 9, 2008, the Downtown Overlay District "Wings" sub -committee conducted a public meeting to discuss the elements of the district and proposed district boundary recommendations to the Planning Commission; and WHEREAS, On April 21, 2008, following proper notice, the Planning Commission held a public meeting to discuss the Port Orchard Comprehensive Plan 10-Year Update, including reports from the Tremont Corridor sub -committee and from the Downtown Overlay District "Wings" sub- committee; and WHEREAS, On May 5, 2008, the Tremont Corridor sub -committee conducted a public meeting to discuss the elements of the district and proposed land use recommendations to the Planning Commission; and WHEREAS, On May 14, 2008, the Downtown Overlay District "Wings" sub -committee conducted a public meeting to discuss the elements of the district and proposed land use recommendations to the Planning Commission; and WHEREAS, On May 19, 2008, following proper notice, the Planning Commission held a public meeting to discuss the Port Orchard Comprehensive Plan 10-Year Update, including reports from the Tremont Corridor sub -committee and from the Downtown Overlay District "Wings" sub- committee; and WHEREAS, On June 9, 2008, the Tremont Corridor sub -committee conducted a public meeting to discuss the elements of the district and proposed development regulation recommendations to the Planning Commission; and WHEREAS, On June 11, 2008, the Downtown Overlay District "Wings" sub -committee conducted a public meeting to discuss the elements of the district and proposed development regulation recommendations to the Planning Commission; and WHEREAS, On June 16, 2008, following proper notice, the Planning Commission held a public meeting to discuss the Port Orchard Comprehensive Plan 10-Year Update including reports from the Tremont Corridor sub -committee and from the Downtown Overlay District "Wings" sub- committee; and WHEREAS, On July 21, 2008, following proper notice, the Planning Commission held a public meeting to discuss the Port Orchard Comprehensive Plan 10-Year Update; and WHEREAS, Port Orchard issued an Environmental Checklist, signed on September 5, 2008, pertaining to the 2008 Port Orchard Comprehensive Plan 10-Year Update; and Ordinance No. 042-08 Page 3of°5 WHEREAS, On September 5, 2008, Port Orchard issued a Notice of Adoption of Existing Environmental Documents, including required legal notification, pertaining to the 2008 Port Orchard Comprehensive Plan 10-Year Update and notice was issued to the Washington State Department of Ecology pursuant to WAC 197-11-630; and WHEREAS, On September 15, 2008, pursuant to WAC 197-11-340(2)(a)(v), Port Orchard issued a Determination of NonSignificance (DNS) for the Adoption of the 2008 Port Orchard Comprehensive Plan 10-Year Update. The appeal period closed at 4:30 PM on September 29, 2008, and no appeals were filed; and WHEREAS, On September 15, 2008, Port Orchard issued draft 2008 Port Orchard Comprehensive Plan Update. The document was posted on the PortOrchardPlan.com and CityofPortOrchard.us web page and made available to the public and agencies. Additionally, in September, October, and November 2008, approximately three thousand mailings were sent to property owners within City Limits through sewer and water billings. The mailing included information on the document release, comment opportunities, and dates of the meetings and upcoming public hearings; and WHEREAS, On September 15, 2008, notice of all amendments to the Comprehensive Plan was sent to the Washington State Department of Community, Trade, and Economic Development at least sixty days before the amendments were adopted, in accordance with RCW 36.70A.106; and WHEREAS, On September 15, 2008, following proper notice, the Planning Commission held a public Open House / Draft Document Workshop Meeting to discuss the elements of the draft_ Port Orchard Comprehensive Plan 10-Year Update and begin the 60 day comment period; and WHEREAS, On September 23, 2008, following proper notice, the City Council held a public Open House / Draft Document Workshop Meeting to discuss the elements of the draft Port Orchard Comprehensive Plan 10-Year Update; and WHEREAS, after proper notice, the Port Orchard Planning Commission conducted a public hearing on Monday, October 20, 2008 and considered public testimony regarding the proposed Port Orchard Comprehensive Plan 10-Year Update; and WHEREAS, after proper notice, the Port Orchard Planning Commission held a public. meeting on. Monday, November 17, 2008 to discuss, deliberate, and recommend approval of the Port Orchard Comprehensive Plan with revisions as identified in Planning Commission Resolution 009-08, a copy of which is attached hereto as Exhibit A; and WHEREAS, after proper notice, the City Council of Port Orchard conducted a public Ordinance No. 042-08 Page 4 of 5 hearing on Tuesday, November 25, 2008 and considered additional public testimony regarding the proposed Port Orchard Comprehensive Plan 10-Year Update; and WHEREAS, all comments received from state agencies as a result of the 60-day review period required by the GMA have been incorporated into the amendments; and THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. The City Council hereby adopts as its own the Findings and Conclusions set forth in Planning Commission Resolution No. 009-08, a copy of which is attached as Exhibit A and made a part of this Ordinance. SECTION 2m The City Council also finds as follows: The amendments adopted by this ordinance are within the range of the alternatives analyzed in the Kitsap County 2006 Draft Environmental Impact Statement (DEIS) and within the scope of additional analysis contained within the Kitsap County 2006 Final Environmental Impact Statement (FEIS). The adopted Kitsap County 2006 FEIS also provides updated responses to comments on the Integrated Port Orchard/South Kitsap Sub -Area Plan Draft EIS consistent with the 10-Year Update. The County prepared a Preliminary Final Sub -Area Plan EIS that addressed comments prior to final decisions on the 10-Year Update. The Kitsap County 10-Year Update FEIS completes the Port Orchard/South Kitsap Sub -Area Plan environmental review process. SECTION 3. In accordance with the above described Findings and Conclusions, the City Council hereby amends the text and map of the Comprehensive Plan by approving and adopting the following: The 2008 Draft Port Orchard Comprehensive Plan 10-Year Update dated September 15, 2008; 2. The revisions to the Comprehensive Plan and Land Use and Zoning Maps as set forth in Planning Commission Resolution No. 009-08, except as to recommendation 2.h. 3. The Planning Department Recommendations and Clerical Correction Matrix, attached as Exhibit B and made a part of this Ordinance. 4. Tax Parcel No. 4038-002-002-0101, Known as 1519 Roland Avenue, shall receive a Comprehensive Land Use designation of Commercial and a Zoning designation of Business Professional. 5. Tax Parcels No. 102301-4-001-2007, 102301-3-001-2009, 102301-3-007-2003, and 102301-3-001-2007, shall receive a Comprehensive Land Use designation of Commerclal Ordinance No. 042-08 Page S of S and a Zoning designation of Mixed -Use, SECTION 4. The 2008 Comprehensive Plan text and map amendments, zoning designations, and appendices shall be effective January 1., 2009. All Business Professional zoning designations shall be effective upon adoption of the Land Development Regulations for the Business Professional zone. SECTION S. If any sentence, section, provision, or clause of this ordinance or its application to any person, entity or circumstance is for any reason held invalid or unconstitutional, the remainder of the ordinance, or the application of the provision to other persons, entities, or circumstances is not affected. SECTION 6 . This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law. WHEREAS, The Growth Management Act (GMA), RCW 36.70A requires that each city planning under GMA must periodically review, and, if needed, revise their comprehensive plans and development regulations every seven years to ensure compliance with the Growth Management Act; a n d WHEREAS, with the passage of the Washington State Growth Management Act in 1990, developing communities are required to submit a comprehensive plan that outlines strategies to accommodate the needs of a growing population. Planning Commission Resolution 009-08 Page 1 of 4 THE PX�NNING COMMISSION OF THE CITY OF PORT ORCHARD, WASHINGTON, MAKES THE FOLLOWING FINDINGS WITH RESPECT TO THE PORT ORCHARIT, COMPREHENSIVE E 1. These amendments were developed in consideration of the goals of the GMA for the development of local comprehensive plans, as codified at RCW 36.70A.020, and reflect a careful balancing of these goals within the local conditions of the City of Port [orchard. 2. These amendments were developed from and are consistent with the Kitsap Countywide Planning PoliciesCPPsj. 3. There has been early and continuous public. participation in the review of the proposed amendments, as required by the GMA, and consistent with the State Environmental Policy Act. 4. The Planning Commission bases its finding and conclusions on all the testimony, oral or written, and exhibits submitted to the Commission. Any finding that should be deemed a conclusion, and any conclusion that should be deemed a finding, is hereby recommended as such. 5. The Planning Commission has considered the following criteria consistent with the Port Orchard Municipal Code and makes the following findings; a. Circumstances in Port Orchard have substantially changed since the adoption of the 1995 Comprehensive Plan and / or subsequent amendments; b. New information is available that was not considered in the adoption of the 1995 Comprehensive Plan and/or subsequent amendments; c. The proposed amendments are consistent with or support other plan elements acid/or development regulations. d. The proposed amendments reflect the goals, objectives, and policies of the Comprehensive Plan; e. The proposed amendments are consistent with: the Countrywide Planning Policies; and f. The proposed amendments are compliant with the requirements of the Growth Management Act. 1. The Port. Orchard Planning Commission approved a motion to recommend approval to the City Council of the 2008 Draft Part Orchard Comprehensive Plan Update dated September 16, 2008; Planning Commission Resolution 009-08 Page 2 of 4 2. The Port Orchard Planning Commission approved a motion to recommend approval to the City Council of the following amendments to the 2008 Draft Port Orchard Comprehensive Plan Update; a. The Port Orchard Planning Commission approved a motion to recommend approval of an amendment to Draft Port Orchard Comprehensive Plan and associated maps to revise the Downtown Overlay district East "Bethel Wing" boundary to follow the limits of parcels designated as Commercial zoning on the east side of Bethel Avenue, as depicted in Exhibit A. b. The Port Orchard Planning Commission approved a motion to recommend approval of an amendment to Draft Port Orchard Comprehensive Plan and associated maps to revise the Comprehensive Plan Land. Use [designation and the Zoning designations for the Tremont Corridor parcels to reflect the land use and zoning designations depicted in Exhibit B. c. The Port Orchard Planning Commission approved a motion to recommend approval of an amendment to Draft Port Orchard Comprehensive Plan and associated reaps to revise the Kitsap County owned properties, Tax Parcels 4059- 007-001.-0105, 4059-007-005-0002, 4059-007-009-0008, 4.059-008-001-0103, 4059-008-001-0004, 4059-008-006-0009, 4059-008-005-0208 and 4059-008-009- 0006 to reflect a Comprehensive Land Use designation of Public and Community Spaces and a Zoning designation of Public Facilities. (comment 5) d. The Port Orchard Planning Commission approved a motion to recommend approval of an amendment to Draft Port Orchard Comprehensive Plan and associated maps to revise Tax Parcel No. 8503-001-001.-0002 to reflect a Comprehensive Land Use designation of Commercial and a Zoning designation of Mixed Use. The Port Orchard Planting Commission denied a motion and deferred to City Council for an amendment to revise the following Downtown Overlay District Vilest Wings parcel: 4044-001-001-0007 to reflect a Height of 55'. (Comment 1.1.) f. The Port Orchard Planning Commission approved a motion to recommend approval of an amendment to Draft Port Orchard Comprehensive Plan and associated maps to revise the following parcels: 1.22301-2-035-2108 and 122301.- 2-035-2009 to reflect a future Comprehensive Land Use designation of Commercial and a future Zoning designation of Commercial. (Comment 1.8) g. The Port Orchard Planning Commission denied a motion of an amendment to Planning Commission Resolution 009-08 Page 3 of 4 Draft Port Orchard Comprehensive Plan and associated maps for an amendment to revise the following Government Civic Center District boundary to include the following parcel. 4053-001-009-0007 and a revision: to reflect, a Comprehensive Land Use designation of Commercial and a Zoning designation of Business Professional (Comment 20) h. The Port Orchard Planning Commission denied a motion of an amendment to Draft Port Orchard Comprehensive Plan and associated maps for an amendment to revise the following parcels: 102301-4-001-2007, 102301-3-001-2009 ' 102301- 3-007-2003 and 102301-3-011-2007 and a revision: to reflect a Comprehensive Land Use designation of High Density Residential and a Zoning designation of Residential 20 (1120).
