044-07 - Ordinance - Amending City's Comprehensive Plan and MapORDINANCE NO. 044-07 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING THE CITY'S COMPREHENSIVE PLAN AND MAP BY DESIGNATING PROPERTIES OWNED BY ROGER LINDELL (TAX NOS. 252401-2-037-2001; 252401-2-038-2000; 252401-2-030- 2008; AND, 252401-2-029-2001) AS HIGH DENSITY RESIDENTIAL/GREEN BELT. WHEREAS, on June 12, 1995 the City Council by Ordinance No. 1634 adopted the City's Comprehensive Plan; and WHEREAS, on December 28, 1998 the City Council in Ordinance No. 1748 adopted the City's Zoning Ordinance; and WHEREAS, in April 1994 the City Council revised the City Shoreline Management Plan and designated Blackjack Creek as a "Shoreline of Statewide Significance" with a 200 ft. buffer, which is designated "Greenbelt" on the Comprehensive and Zoning Maps; and WHEREAS, the applicant is seeking to change the Comprehensive Plan designation and Map for four parcels totaling 2.16 acres from Medium Density Residential to High Density Residential; and WHEREAS, a portion of this site is within the 200 ft. buffer area of Blackjack Creek and that section should be designated "Greenbelt"; and WHEREAS, the Planning Commission met on December 5, 2007 and resolved to recommend approval of the proposal, based on the findings that the proposed designation was consistent with the Comprehensive Plan and the uses on other adjacent parcels in the area; and WHEREAS, the City Council has received the recommendation of the Planning Commission concerning these issues, held a public hearing on December 10, 2007 to take public testimony, and finds that it is in the public interest to amend the Comprehensive Plan and Map to designate the Lindell properties (Tax Nos. 252401-2-037-2001; 252401-2-038-2000; 252401-2-030- 2008; and 252401-2-029-2001) as High Density Residential/Greenbelt with future zoning to be addressed by a site -specific rezone when a development proposal is formally submitted; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 1634, the City of Port Orchard Comprehensive Plan and Map, is hereby amended to designate the Lindell Properties as High Density Residential/Greenbelt. SECTION 2. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
