AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING PORT ORCHARD MUNICIPAL CODE SECTION 14.04.090
REDUCING THE EXEMPT LEVEL FOR PARKING LOTS
WHEREAS, the City has adopted certain SEPA rules set forth in Chapter 197-
11 WAC, as codified in Port Orchard Municipal Code Chapter 14.04 'State Environmental
Policy Act;" and
WHEREAS, WAC 197-11-800(1)(c) authorizes cities to exempt certain types
of construction, including parking lots designed to provide parking spaces for up to a
maximum of 40 automobiles, as codified at POMC 14.04.090; and
WHEREAS, the City desires to reduce the maximum exempt level for parking lots
from 40 spaces to 20 spaces so that the exemption complies with local conditions, including
recently amended zoning and other land use regulations; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO
ORDAIN AS FOLLOWS:
SECTION 1. Port Orchard Municipal Code Section 14.04.090 is hereby amended to read as
follows:
14.04.090 Flexible thresholds for categorical exemptions.
The City establishes the following exempt levels for minor new construction under
WAC 197-11-800(1)(c):
(1) For residential dwelling units in WAC 197-11-800(1)(c)(i): Up to four
dwelling units.
(2) For buildings in WAC 197-11-800(1)(c)(ii): Up to 12,000 square feet.
(3) For parking lots in WAC 197-11-800(1)(c)(iv): Up to 20 parking
spaces.
(4) For landfills and excavations in WAC 197-11-800(1)(c)(v): Up to 500
cubic yards.
SECTION 2. This ordinance shall be in full force and effect five (5) days after posting and
publication as required by law. A summary of this Ordinance may be published in lieu of the entire
ordinance, as authorized by State Law.
