006-07 - Ordinance - Relating to the Fee Requirememts for Relocation of Signs from the MarqueeORDINANCE NO. 006-07 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, TEPORARILY SUSPENDING CERTAIN PROVISIONS OF THE PORT ORCHARD MUNICIPAL CODE SECTION 15.16.060 AND AMENDING SECTION 15.16.120 RELATING TO THE FEE REQUIREMENTS AS WOULD BE APPLIED TO THE RELOCATION OF SIGNS FROM THE MARQUEE AND RELATING TO THE LOCATION OF DOWNTOWN BUSINESS CORE MARQUEE SIGNS WHEREAS, the downtown marquee is currently being repaired and renovated by the City of Port Orchard; and WHEREAS, the Port Orchard Municipal Code (POMC) Chapter 15.16 regulates signs and sign placement within the City; and WHEREAS, the POMC section 15.16.120, which regulates downtown business core marquee signs, allows the placement of signs on the downtown marquee; and WHEREAS, the POMC section 15.16.040 requires a permit for the erection, re - erection, attachment, structurally altered, or relocation of signs; and WHEREAS, the POMC section 15.16.060 requires the payment of fees beforeany sign permit is issued; and WHEREAS, the City Council finds that it is desirable to temporarily suspend the provisions of POMC Section 15.16.120 that currently allow for the attachment of signs to the face of the marquee to prevent the impairmentof the City's ability to repair and renovate the downtown marquee; and WHEREAS, the City Council finds that, although a permit will be required for relocation of a sign from the marquee, the downtown business owners should not have to pay for the permit fees as the need for relocation of signs is due to the current repairs to the City's marquee; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. Section 15.16.060 of the Port Orchard Municipal Code relating to the requirement for the payment of fees before a sign permit is issued is suspended as it relates to the erection, re -erection, attachment, structurally altered, or relocation of downtown business core marquee signs. The suspension of fees pursuant to this section shall only apply to the erection, re - erection, attachment, structurally altered, or relocation of a sign that previously existed and was attached to the downtown marquee. Ordinance No. 006-07 Page 2 of 4 SECTION 2. Section 15.16.120 of the Port Orchard Municipal Code relating to the downtown business core marquee signs is hereby amended to read as follows: 15.16.120 Downtown business core marquee signs. Abutting property owners can use that portion of the marquee which is within the extended property lines to advertise those businesses which are located on the subject property. All marquee signs shall have a building permit to confirm location, design standards, and structural connection. The city is authorized to relocate or remove any sign on the marquee or in the public right-of-way that does not conform to city standards. No sign shall advertise a business that is not located on the abutting Bay Street property. No temporary signs or banners shall be allowed on the marquee, except those installed by the city. No display of merchandise shall be hung from the marquee. (1) Allowable Area for Marquee Signage. One square foot for each lineal foot of wall frontage. Marquee sign is part of the total usable signage for the site. No single sign face shall exceed 32 square feet. The property owner of a multiple occupancy building will be responsible for the division of usable signage and signs shall be spaced evenly. (2) Design Criteria. (a) The sign shall be placed directly in front of business. Proportional size length to width is approximately with ratio of 2:1 minimum. See following diagram. (b) All signs shall have a professional appearance. (c) No sign is to have a right angle corner. The sign can be finished in a manner such as seen below. A clearance of 14 feet for commercial vehicles must be permitted. The lighting must be shielded from traffic and avoid undue brightness. See POMC 15.16.080(2). Subject to permit and design criteria. See following diagram. Light s ie-:d for traffic f� Y P l (e) Signs under the marquee shall be placed to allow seven feet clearance above the sidewalk. The sign shall be rectangular in shape, not to exceed six square feet, corner treatment is as follows, and shall be installed per city standards. An example of the sign design, which must be used, is as follows: (f) Any movie theater with more than 150 seats is exempt from the standards of this section, but must meet requirements of POMC 15.16.110. (g) Changeable letter strips may be added to a marquee sign for those businesses that pay a state/local admission tax for use of entertainment advertising only. (3) All sign permits issued for the erection, re -erection, attachment, structurally altered, or relocation of downtown business core marquee signs pursuant to the provisions of this ordinance shall contain notice that the permit is "temporary," that the City is considering a Downtown Overlay District (DOD) ordinance, and that signage will be required to meet any approved DOD regulations and design standards in the future. Ordinance No. 006-07 Page 4 of 4 (4) No sign may be attached to the face or top of the downtown marquee. Signs may be permitted to be attached to the underside of the marquee if all the provisions of this section are met. SECTION 3. The provisions of this ordinance are intended to be temporary but shall remain in effect until this ordinance is repealed or amended by action of the City Council. SECTION 4. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
