017-07 - Ordinance - Amending Ordinance 005-07 by Recinding Moratorium on Home ProfessionsORDINANCE NO. 017-07 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING ORDINANCE 005-07 BY RECINDING A MORATORIUM ON HOME PROFESSIONS AS ACCESSORY USES IN RESIDENTIAL ZONES. WHEREAS, on March 26, 2007 the City Council passed Ordinance 005-07 imposing a moratorium on Home Occupations and Home Professions as accessory uses within all residential zones; and WHEREAS, on May 14, 2007, the City Council held a public hearing on the moratorium in accordance with RCW 35.63.200; and WHEREAS, since the City Council last took action on this item it has been determined that the impact on Home Professions currently licensed within the City, and the ability for future Home Professions to establish themselves in the City is greater than was anticipated by the City; and WHEREAS, the primary concern with Home Professions, as opposed to Home Occupations, is the impact of signage within a residential community; and WHEREAS, the impacts of signage associated with Home Professions can be managed by adopting a separate moratorium while allowing the Home Profession uses to continue; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. That Section 1 of Ordinance No. 005-07 is hereby amended by rescinding the moratorium on Home Professions and deleting all references to "Home Professions" to read as follows: Section 1. A moratorium is hereby imposed upon home occupations as accessory uses within all residential zones in the City. While this moratorium is in effect, no home occupations shall be allowed as accessory uses within any residential zone in the City and no business license shall be issued for such use, unless the home occupation was an established legal use prior to the effective date of this ordinance. SECTION 2. That Section 2 of Ordinance No. 005-07 is hereby amended by deleting reference to "Home Professions" to read as follows: Section 2. As used in this ordinance, "home occupation" shall have the meanings as defined in Part 132 of Ordinance No. 1748. Ordinance No. 0 17-07 Page 2 of 2 SECTION 3. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
