027-06 - Ordinance - Amending the 2006 BudgetAN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, DECLARING AN EMERGENCY AND AMENDING THE BUDGET FOR THE YEAR 2006 AS ADOPTED BY ORDINANCE NO. 025-05. WHEREAS, the City of Port Orchard adopted its 2006 Budget in Ordinance No. 025-05; and WHEREAS, the City Council appropriated money in the 2006 budget for the drilling of Well No. 10; said appropriation to be funded by transferring monies from the Water -Sewer Cumulative Reserve Fund to the Water -Sewer Operating Fund; and WHEREAS, at the October 24, 2005 meeting the City Council awarded the bid for drilling of Well No. 10 for $203,614.14 and at the April 10, 2006 meeting Change Order #1 in the amount of $151,520 was authorized; subsequently, Change Order #2 in the amount of $56,254 was authorized at the June 26, 2006 meeting; subsequent to that action, Change Order #3 in the amount of $45,981.24 was authorized at the September 26, 2006 meeting in order to complete the drilling for Well No. 10; and WHEREAS, at the June 26, 2006 meeting the City Council authorized Change Order #1 to the design contract for Well No. 10 in the amount of $18,500.00; subsequently Change Order #2 was authorized at the September 7, 2006 meeting in the amount of $15,000; and WHEREAS, the 2006 budget provided for $100,000 for the Well No. 10 project and Ordinance 010-06 passed on May 8, 2006 increased the 2006 budget for the Well No. 10 project by $300,000; and WHEREAS, subsequent to the additional appropriation in Ordinance 010-06, there have been additional costs for the Well No. 10 project including site preparation, permits, and labor costs for public works inspection totaling $125,000; and WHEREAS, the source of revenue for the additional appropriation for the Well No. 10 project will come from the transfer of funds from the Water -Sewer Cumulative Reserve Fund to the Water - Sewer Operating Fund; and WHEREAS, jail costs have increased, and to date an additional $45,000 has been incurred for such costs over what was budgeted for jail costs when the 2006 budget was adopted in Ordinance 025- 05; and WHEREAS, the City has incurred costs in 2006 totaling $55,000 for the removal of two sunken boats; and WHEREAS, the City Council, at the May 22, 2006 meeting, upon recommendation from the Lodging Tax Advisory Committee, approved additional expenditures from hotel/motel tax revenues totaling $8,000; and WHEREAS, the City has received certain revenues in excess of estimated revenues as set forth in Ordinance 025-05 from sales tax and from reimbursement from the State of Washington and a private parry for sunken boats removal; and WHEREAS, unencumbered portions of fund balances are available to offset additional 2006 expenditures; and WHEREAS, the City Council declares an emergency pursuant to RCW 35.33.091 for the purpose of meeting additional expenditures in 2006 not reasonably foreseeable at the time the 2006 budget was adopted in Ordinance 025-05; now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: Section 1. That the 2006 Budget be amended to reflect the following: (a) Transfer of revenue in the Water -Sewer Cumulative Reserve Fund to the Water - Sewer Operating Fund: $125,000,00. (b) Appropriation to pay for the costs of design and drilling Well No. 10 from the Water - Sewer Operating Fund: $125,000.00. Section 2. That the 2006 Budget be amended to reflect the following additional revenues: (a) From sales tax in the amount of $45,000. (b) From the State of Washington and from a private party in the amount of $55,000 for sunken boat removal. (c) Unencumbered fund balance from Community Events Fund totaling $8,000. Section 3. That the 2006 Budget be amended to reflect the following: (a) Appropriation of $100,000.00 from the Current Expense Fund to pay for additional expenditures for jail costs and sunken boat removal. (b) Appropriation of $8,000.000 from the Community Events Fund to pay for the Festival of Chimes & Lights. Section 4. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this ordinance may be published in lieu of the entire ordinance, as authorized by State law.
