1945 - Ordinance - Amending Title 15 for State Building CodeORDINANCE NO. 1945 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, ADOPTING UPDATES TO THE STATE BUILDING CODE AND AMENDING PORT ORCHARD MUNICIPAL CODE SECTIONS 15.04.010 AND 15.08.010 AND DELETING SECTION 15.04.020 WHEREAS, the state building code council periodically adopts uniform codes of statewide applicability, collectively referred to as the state building code; and WHEREAS, the state building code council has updated the state building code by adopting the 2003 editions of the International Code Council building, residential, and mechanical codes and the International Association of Plumbing and Mechanical Officials plumbingcode; and WHEREAS, the state building code council did not adopt several provisions of International Association of Plumbing and Mechanical Officials plumbing code relating to sewers and fuel gas piping; and WHEREAS, the City Council finds that the public health, safety, and welfare would be served by adopting the updated version of the state building code; ow, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES ORDAIN AS FOLLOWS: as follows: SECTION 1. Port Orchard Municipal Code Section 15.04.010 is AMENDED to read 15.04.010 Building Code Adopted. (1) Pursuant to RCW 19.27.031 and RCW 35.21.180, the 2003 Editions of the International Building Code, the International Residential Code, and the International Mechanical Code, as adopted by the state building code council and published by the International Code Council, Inc., as well as the 1997 Edition of the Uniform Code for the Abatement of Dangerous Buildings, as adopted and published by the International Conference of Building Officials, together with the appendices of all such codes, are hereby adopted as the official building code of the City of Port Orchard as though fully set forth herein, subject to the amendments and additions set forth in this title, for the purpose of prescribing regulations governing conditions to life and property. Once copy of such codes is on file in the office of the City Clerk. (2) Any enforcement action commenced under a prior code shall remain in full force and effect unless the misconduct charged under the prior code is lawful under the newer code. (3) The 2003 Edition of the International Building Code is amended to read as follows: Ordinance No. 1945 Page 2 of 4 (a) Subsection 105.2 is amended to read as follows: 105.2 Work exempt from permit. Exemptions from permit requirements of this code shall not be deemed to grant authorization for any work to be done in any manner in violation of the provisions of this code or any other laws or ordinances of this jurisdiction. Permits shall not be required for the following: (1) One-story detached accessory structures use as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 200 square feet. (2) Fences not over 6 feet (1829 mm) high. (3) Oil derricks. (4) Retaining walls which are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II or III -A liquids. (5) Water tanks supported directly on grade if the capacity does not exceed 5,000 gallons (18 925 L) and the ratio of height to diameter or width does not exceed 2 to 1. (6) Sidewalks and driveways not more than 30 inches (762 mm) above grade and not over any basementor story below and which are not part of an accessible route. (7) Painting, papering, tiling, carpeting, cabinets, counter tops and similar finish work. (8) Temporary motion picture, television and theater stage set; and scenery. (9) Prefabricated swimming pools accessory to a Group R-3 occupancy, as applicable in Section 101.2, which are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (18 925 L) and are installed entirely above ground. (10) Shade cloth structures constructed for nursery or agricultural purposed and not including service systems. (11) Swings and other playground equipment accessory to detached one- and two-family dwellings. Ordinance No. 1945 Page 3 of 4 (12) Window awnings supported by an exterior wall which do not project more than 54 inches (1372 mm) from the exterior wall and do not require additional support of Group R-3, as applicable in Section 101.2, and Group U occupancies. (13) Moveable cases, counters and partitions not over 5 feet 9 inches (1753 mm) in height. (b) A new Subsection 108.7 is added to read as follows: The Building Official is authorized to waive the Permit Fee and Plar Review specified in the International Building Code and in the Uniform Plumbing Code upon satisfaction of the following conditions: (1) The permit is for a residential unit of an owner/occupier who is 60 years or older with a maximum annual income, together with all persons in the household, below the poverty line as established by the Office of Management & Budget in Washington D.C. (2) The work is for essential repairs and improvements, such as insulation, weatherization, roof repairs, structural repairs or essential plumbing repairs. (3) The owner/occupant of the home completes a form supplied by the Building Official requesting exception from the Building Permit Fees. SECTION 2. Port Orchard Municipal Code Section 15.04.020 is DELETED in its entirety. SECTION 3. Port Orchard Municipal Code Section 15.08.010 is AMENDED to read as follows: 150.08.010 Adoption of the Uniform Plumbing Code. (1) Pursuantto RCW 19.27.031 and RCW 35.21.180, the Uniform Plumbing Code and Uniform Plumbing Code Standards published by the International Association of Plumbing and Mechanical Officials, as adopted by the state building code council, togetherwith all appendices to such code, are adopted as the official plumbing code of the city. Once copy of said code is on file in the offices of the City Clerk. The building official shall be the administrative authority as referenced in the plumbing code. SECTION 4. This ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire ordinance, as authorized by State Law.
