Tax Parcel Number: 342401-4-076-2008 Legal Description: That portion of the Southeast quarter of the Southeast quarter of Section 34,Township 24 North, Range 1 East, W.M. City of Prot Orchard, in Kitsap County, Washington, or as described in "Exhibit A". WHEREAS, the Port Orchard City Council did on March 8, 1993 approve Ordinance No. 1572 to reclassify property located in the 400 block of Tremont Street West; East of SR16, between Tremont Street and Pottery Avenue from Residential High to Commercial General and Multi -family 20 to allow site development of mixed land uses, subject to twenty- four (24) conditions; and WHEREAS, said property was reclassified Community Facilities with the adoption of the 1998 Zoning Ordinance; and WHEREAS, the original site -specific plan set forth in Ordinance No. 1572 has been revised on several occasions as set forth in Ordinance Nos. 1586, 1604, 1609, and 1737; and WHEREAS, N.L. Olson and Associates, representing Harrison Hospital, has submitted an application for site plan revision for the South Kitsap Health Care Campus, requesting to allow the construction of a health care clinic on approximately 29,700 square feet of the Health Care Campus, and WHEREAS, A DNS was issued on June 6, 2004; and 6 Ordinance No. 1954 Page 2 of 4 WHEREAS, the City Council held a public hearing on September 13, 2004 to consider the revisions to the site -specific plan; and being fully advised, the City Council finds and concludes as follows: TESTIMONY AND EXHIBITS The Council bases its Findings and Conclusions on the following Exhibits and Testimony that it finds to be relevant, credible and persuasive: 1. The following documents were admitted into the record: A. Staff Report and Planner's Memo, dated August 3, 2004. B. SEPA checklist. C. Proposed Site Plan. D. Project Narrative. E. Site Plan Overlay onto Master Plan. F. Proposed Elevations. G. Proposed Short Plat. H. Ordinance numbers 1572; 1586; 1604; and 1737. I. Resolution 1808. 2. Glynis Casey, associate planner, summarized the applicant's proposal and the City's review. 3. Barbara Malich testified on behalf of Peninsula Health Care Services. She commented on their interest in locating their facility within the Campus site, and in support of the modification to the site -specific plan. 4. Steve Johnson, architect, testified on behalf of the applicant. He addressed the architectural and site planning details of the applicant's proposal. 5. Tim Arnold testified on behalf of Harrison Hospital. He addressed the details of the applicants proposal. He stated that the applicant did not object to any of the proposed conditions. He also addressed issues relating to design guidelines. 6. Norm Olson of Olson and Associates testified on behalf of the applicant. He addressed the engineering details of the applicants proposal. 7. Gil Michael, Port Orchard resident, expressed concern with the proposed setbacks not meeting the South Kitsap Health Care Design Guidelines. FINDINGS 1. The South Kitsap Health Care Campus Master Plan was approved under Ordinance 1572 on March 8, 1993. Peninsula Community Health Services (PCHS) is proposing to construct a new two-story 14,000 s.f. community health clinic with associated parking and required landscaping. 3. The proposed site is located within the existing South Kitsap Health Care Campus, adjacent to the existing Memory Care Clinic. 4. The site is designated Community Facilities by the Comprehensive Plan and the City Zoning Map. 5. The .86-acre property will be purchased from Harrison Memorial Hospital by PCHS for the building and parking site. An additional piece of property is proposed to be leased for parking. 6. The proposed revisions to the site -specific plan are consistent with the intent of the master plan to provide support services to the medical campus, and to provide for coordinated planning and design. 7. The South Kitsap Health Care Campus site was developed and approved with a regional stormwater facility that provides for water quantity and quality for the entire area, including the area of the Peninsula Community Health Care project. 8. The proposed project meets and or exceeds the intent of the original stormwater design. The project does not propose additional stormwater storage and the roof runoff will not require treatment, as would the original parking area. 9. The proposed building design is not fully consistent with the "South Kitsap Health Care Campus Design Guidelines" but the project has been reviewed by the Hospital's design committee and is supported by Harrison Hospital. 10. The applicant has not objected to any of the recommendations set forth in staffs August 3, 2004 memorandum. CONCLUSION 1. The Comprehensive Plan's designation for the subject property is Community Facilities and the proposed development is consistent with the goals and policies of the Comprehensive Plan. 2. The site plan modification is not detrimental to the health, safety, morals and general welfare of the community and is in harmony with the general purposes of the Zoning Ordinance and the Growth Management Act. 3. It is in the best interest of the community to allow revision of the site plan to allow for the site development and construction of the Peninsula Community Health Care Clinic within the South Kitsap Health Care Campus. WHEREFORE, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DO ORDAIN AS FOLLOWS: SECTION 1. Based upon the recommendations of City Staff and the Findings and Conclusions set forth herein, the revised site specific plan for the construction of a health care clinic at the property located at the 400 block of Tremont Street West; East of SR16, between Tremont Street and Pottery Avenue is hereby approved, subject to the 17 conditions of approval attached hereto as Exhibit "B". This approval is site plan specific to the South Kitsap Health Care Campus Master Plan. Pursuant to Part 2, Section 11 of the City of Port Orchard Planning and Development Procedures, any major modification, deviation or departure from the originally approved site plan or application shall constitute a violation of the zone adjustment approval unless the City Council has reviewed and approved a modified site plan after conducting a public hearing. The City Council may subject modified site plans to new conditions. SECTION 3. This Ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire Ordinance, as authorized by State law. The project will be treated as a Site Specific Plan. 2. A bus stop will be constructed along S. Kitsap Blvd. and the entrance to the health care clinic to accommodate both directions of travel. 3. The applicant shall include a written policy that will be offered to employees for compliance with the Kitsap County Transit Commute Trip Reduction Plan. The plan shall identify the number of parking spaces to be dedicated to "ride share" or "car pool". The parking places shall be denoted on the plan. 4. All signs shall be consistent with the requirements of the Tremont Corridor Specific Plan. 5. No pole signs shall be allowed. 6. All electrical utilities will be underground. 7. Prior to issuance of the building permit, the landscaping plan shall be approved. Landscaping criteria shall conform to the requirements of the Tremont Corridor Specific Plan. 8. Prior to final inspection, the landscaping shall be installed, inspected and approved by the planning department. 9. The developer will provide a bond to the City to assure proper landscaping maintenance for two years after planting. 10. Containment, handling, storage and transportation of biomedical waste shall be in a manner and location consistent with state and county regulations. Stormwater 1. The applicant's engineer will be required to certify that the existing conveyance capacity to the pond and water quality treatment facility meets the original design and requirements of the City of Port Orchard Ordinance and Stormwater Design Manual in effect at this time, to include the proposed project. 2. The applicant's engineer is to provide calculations and certification for capacity of the detention facility to meet the original design and required standards of the City of Port Orchard Ordinance and Stormwater Design Manual in effect at this time, to include the Fire proposed project. 13. Fire flows will be established by the Fire Department. 14. Because the building is over 10,000 square feet, a fire sprinkler system and a fire alarm system is required to be installed. The Chief may reduce these requirements for the fire alarm system for buildings protected by an approved sprinkler system. 15. Plans for the fire alarm system and the sprinkler system must be approved by Kitsap County Fire District #7 prior to installation. Separate permits are required for each installation. Submittals for review must include specifications on all devices to be installed. 16.If any of the building occupants plan to use store or handle any flammable or combustible liquids or hazardous materials, information on the type and quantities of materials need to be submitted to the fire District so that further building and storage requirements may be addressed. 17. Prior to issuance of the building permit, all construction plans shall be reviewed and approved by the fire department.
