1927 - Ordinance - Amending the Comp Plan MapCity of Port Orchard 216 Prospect Street Port Orchard, WA 98366 II 200312290200 I IIIIII IIIII IIIIII III IIIII IIIlIIII IIIII III IIIII IIII IIII 1Page I of 6 2/29' 20Q, 12 25P PORT ORCHARD CITY OF ORO $24.00 Kits* Co, 4 ORDINANCE NO. 1927 AN ORDINANCE OF THE CITY OF PORT ORCHARD AMENDING THE COMPREHENSIVE PLAN MAP THAT WILL APPLY A GOVERNMENT -USE MASTER PLAN OVERLAY DISTRICT DESIGNATION, AND MAKING COMPREHENSIVE PLAN TEXT CHANGES WITH REGARDS THERETO, AND AMENDING CITY OF PORT ORCHARD COMPREHENSIVE PLAN ORDINANCE NO.1634 ACCORDINGLY WHEREAS, State Law RCW 36.70A.130 dictates that cities shall at least every five years take action to review and, if needed, revise its Comprehensive Plan; and WHEREAS, with the passage of the Washington State Growth Management Act in 1990, developing communities are required to submit a comprehensive plan that outlines strategies to accommodate the needs of a growing population. It is intended for this comprehensive plan to be updated to reflect the changes in growth and boundaries of that growth including changes to zoning; and WHEREAS, the City Council approved Resolution 1918 with the intent of providing direction to Kitsap County for future facility expansions, and private government support uses, to be within the area of Dwight and Sroufe Streets, and, Cline and Austin Avenues; and WHEREAS, the Applicant is requesting approval of a Comprehensive Plan Amendment to "Public and Community Spaces", together with approval of a conceptual Master Plan to support a Rezone of the subject properties, from R8 to Public Facilities, through phased application for phased development; and WHEREAS, the County Administration intends to utilize the area for the construction of future office space, and parking, as growth of County governmental services occurs, and funding is available; WHEREAS, the County presented a conceptual Master Plan, to anticipates phasing of development over a period of 30+ years. The first phases of expansion proposed is found adjacent to the current County Courthouse Campus, located south of the Taylor Street, between Sidney Avenue and Cline Avenue. The applicant has stated that this area is needed for the Ordinance No.1927 Page 2 of 5 construction of additional parking to relieve parking congestion in the neighborhood and to meet the needs of the Courthouse Campus; and WHEREAS, the subject area is characterized primarily with single-family residential properties. Land use in the proposed expansion area includes an eight-plex apartment, and an American Legion Hall south of Taylor. The project area also includes two professional offices and z private parking lot approved as Special Use Permits, located at the southeast corner of Sidney Avenue and Division Street. In close proximity to the project boundary are several professional offices that were approved as Special Use Permits. WHEREAS, the proposed expansion area includes properties currently under County ownership, as well as privately owned properties; and WHEREAS, adequate public notice has been given utilizing several public informational mediums, including County sponsored open house sessions to provide an informal setting for the public to gain additional information from the applicant. The Planning Commission held public hearings on August 18th, September 15h, October 6, October 20`", and November 17th. The Planning Commission participated in a Special Study Session Tour of the City regarding the proposed 2002 Comprehensive Plan Amendments on September 6th. WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and conclusions as stated in Resolution 338-03, that CA-18-03 proposing to amend the Comprehensive Plan Map and Text to allow both public and private development within the prescribed overlay district be allowed for the reasons stated therein; WHEREAS, City Staff provided the City Council an overview of the proposed Comprehensive Plan Amendment on November 10, 2003, and at a continued public hearing on December 1, 2002; and, WHEREAS, the City of Port Orchard seeks to be in compliance with the goals, policies, and procedures of the Growth Management Act; and WHEREAS, the City Council makes the following additional findings: 1. That Kitsap County Administration, applicant, has demonstrated a need for expansion and that that 20 years of planned growth can be accommodated in the area between, Dwight Street, Smith Street, Cline Avenue, and Sidney Avenue, where the applicant currently has either purchased, or holds a purchase -sale agreement for the majority of the property within this area; and 2. That allowing a mix of both public and private development in the area between Smith Street, Kendall Street, Cline Avenue, and Sidney Avenue will meet the community's need for additional office space in close proximity to the Kitsap County Courthouse Campus, and is found to be a furtherance of the IIIIII IIIII IIIIII III III�I IIIIIIII IIIII III IIIII IIII IIII 0031c2290200 P 1 PORT ORCHARD CITY OF ORD $2 Ordinance No. 1927 Page 3of5 City's intent to direct office space development to this area as expressed in City Council Resolution 1918; and 3. That approval of a Comprehensive Plan Map and Text Amendment as a Special Government Use Overlay District that will allow both public and private development of government supporting uses is consistent with the intent of the State Growth Management Act Goals (RCW 36.70A), and the City's goals and policies of the community; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DO ORDAIN AS FOLLOWS: SECTION 1. The City Council hereby amends the Comprehensive Plan Map to create a "Government Use Master Plan Overlay District within the area bounded by Dwight Street, Kendal Street, Cline Avenue, and Sidney Avenue, as depicted on Attachment'1'. The map shall designate that the area between Dwight Street, Smith Street, Cline Avenue, and Sidney Avenue will be limited to Government uses; and the area between Smith Street, Kendal Street, Cline Avenue, and Sidney Avenue will be limited to Governmental Use or private Government supporting uses. SECTION 2. The City staff is directed to prepare for consideration by the City Council development regulations creating a Master Site Plan process and related performance criteria so that a Master Site Plan application can be submitted and processed within the Government Use Master Plan Overlay District. SECTION 3. In order to provide guidance for development within the Government Use Master Plan Overlay District, a new paragraph is added to the Comprehensive Plan Land Use Element, regarding "Public and Community Space Land Needs", pg VI-17: "Government Use Master Plan Overlay District The City of Port Orchard is the County seat for Kitsap County. As such, there is an on -going need for County services and immediate support services to be accommodated near the existing County Campus site. The City has recognized this need with directives to provide for expansion of these services within the prescribed boundary of Dwight Street, Cline Avenue, Sroufe Street, and Sidney Avenue. Kitsap County has demonstrated that their needs for office space, and other supporting uses can be accommodated in this area through a planned campus like development, to be phased as needed, and as resources are available. In order to assure the orderly and aesthetic development of the County Campus in a campus like setting, the City has delineated a Government -Use Master Plan Overlay District that will be bounded by Dwight Street, Cline Avenue, Kendall Street, and Sidney Avenue. This area is designated for government use only. To meet the needs of the general community of private services that support the County Administrative functions, the area bounded by Smith Street, Kendall Street, Cline Avenue, and Sidney Avenue will be limited to Governmental Use of private Government supporting uses. The Government Use Master Plan Overlay District recognizes that as phased expansion of the County campus occurs over time, there will be an on- going need to protect the interests of the community to provide for land for expansion, while also protecting the remaining residential properties from the impacts of development. The City intends to develop a Master Site Plan process and related performance criteria so that a Master Site Plan application can be submitted and processed within the Overlay District. All residential uses in the underlying zone classification will continue to be permitted uses, and no new special use permits will be allowed within the Government Use Master Plan Overlay District. Development regulations should be prepared so that existing single family uses within the Government Use Master Plan Overlay District are not materially adversely affected by an abutting Master Plan Overlay use, by the use of appropriate setbacks, landscaping, screening, wall modulation and similar design and layout features. No new government or governmental supporting uses will be allowed within the Government Use Master Plan Overlay District without going through the Master Plan Overlay District, that will define the types of Government Supporting Uses restricted, while limiting permitted uses to those directly related to supporting the Government uses, such as professional office space. The Overlay District anticipates that each Master Site Plan shall be required to coordinate its design and layout so that the entire Government Use Master Plan Overlay District, when fully developed, has an integrated design pattern that makes the area visually and functionally appear as one campus". SECTION 4. The limitation to Government Uses only for a portion of the Government Use Master Plan Overlay District, as referenced in Section 1 above, shall be reviewed in five years to determine if the restriction should be removed. SECTIONS. This Ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the entire Ordinance, as authorized by State law.
