ORDINANCE NO. 1883 AMENDING CITY ZONING ORDINANCE NO. 1748, BY AMENDING THE AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, ZONING MAP FOR PROPERTIES LOCATED ALONG THE NORTH SIDE OF DWIGHT STREET, BETWEEN CLINE AVENUE AND AUSTIN AVENUE. (R-1139) Copies of Ordinance No. 1883 are available for review at the office of the City Clerk of the City of Pori Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. (R-I 139) Tax Account Nos. 4560-006-002-0000; 4560-006-003-0009; 4650- 006-006-0006; and 4650-006-007-0005 Legal Description: Lot 2, 3, 6, & 7, Block 6, S.M. Stevens' Town Plat of Sidney, as per plat recorded in Volume 1 of Plats, page 1, records of Kitsap County, Washington. Located in NW 'A, SE %, of Section 25, Township 24N, Range lE, W.M. WHEREAS, the applicant has initiated a Zone Reclassification Application R-I 139 WHEREAS, the applicant(s) have expressed that the future intended use of the single family requesting to reclassify the subject parcels to "Mixed Use"; and residential sites would be professional office and supporting parking; and WHEREAS, the City of Port Orchard Planning Commission has transmitted to the Council of the City of Port Orchard their findings and conclusions as stated in Planning Commission Resolution No, 327- 02, recommending the Zone Reclassification Application R-I 139 be denied for the reasons stated therein; and WHEREAS, city staff provided the City Council an overview of the proposed Comprehensive Plan Amendments on November 12, 2002, and a Public Hearing was held before the City Council on December 9.2002; and WHEREAS, the City Council finds that proposed professional office/residential use of the site is compatible with the future intended use of the neighboring properties; and WHEREAS, the City Council finds that the proposed Zone Reclassification Application R- 1139 is consistent with the goals of the community, adopted Comprehensive Plan, and general requirements of the Growth Management Act (RCW 36.70A), now, therefore, Ordinance No. 1883 Page 2 of 2 THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES ORDAIN AS FOLLOWS: SECTION 1. That the City Council does hereby approve R-I 139, subject to the staff recommended conditions of approval, and does hereby revise the City's Zoning Map for certain properties as "Mixed Use Commercial", as illustrated on Attachment 'I,, subject to the following conditions: (1) The uses be limited to professional officdmixed residential type uses; (2) That future conversions of the residential units or redevelopment to construct professional office mixed use development is subject to site plan review, that will detail site plan layout, landscaping. building design, storm water and traffidaccess improvements. SECTION 2. Severability. If any section, subsection, paragraph, sentence, clause, or phrase of this Ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity of the remaining portions of this ordinance. SECTION 3. This Ordinance shall be in full force and effect five (5) days after posting and publication as required by law.
