Council meeting held January 27, 2003.

AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING CHAPTER 7.04 OF THE PORT ORCHARD MUNICIPAL
CODE REGARDING ANIMAL CONTROL AND A PORTION OF
ORDINANCE NO. 1750.
Copies of Ordinance No. 1891 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1891 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF PORT
ORCHARD AMENDING CHAPTER 7.04. SUBSECTIONS 7.04.100,
7.04.160, 7.04.170 AND REPEALING SUBSECTION 7.04.150 OF THE
PORT ORCHARD MUNICIPAL CODE REGARDING ANIMAL
CONTROL (Amending a portion of Ordinance No. 1750)
WHEREAS, the City of Port Orchard desires to update its animal control code so that the
violations and provisions therein are consistent with the corresponding state statutes; now therefore,
THE COUNCIL OF THE CITY OF PORT ORCHARD DOES ORDAIN AS FOLLOWS:
Section 1. Section 7.04.100 of the Port Orchard Municipal Code is amended to read as
follows:
7.04.100 Cruelty to animals
The following sections of the Revised Code of Washington (RCW), and any
amendments thereto, are adopted by reference as if fully set forth in this chapter:
RCW 16.52.207.
Section 2. Section 7.04.160 of the Port Orchard Municipal Code is amended to read as
follows:
7.04.160 Animal fighting -- Owners, trainers, spectators -- Exceptions.
The following section of the Revised Code of Washington (RCW), and any
amendments thereto, is adopted by reference as if fully set forth in this chapter:
RCW 16.52.117.
Section 3. Section 7.04.170 of the Port Orchard Municipal Code is amended to read as
follows:
7.04.170 Violation - Penalty -Civil Infraction
Except as otherwise provided, any person violating any provisions of this
chapter, or who creates, keeps or maintains a nuisance as defined in this chapter
is guilty of a civil infraction. The fine for any infraction shall be $40.00 for the first
violation, $75.00 for the second infraction committed within one year and $100.00
for the third and subsequent infractions committed within one year. Each and
every day or portion thereof in which an infraction is committed shall constitute a
separate an distinct infraction.
Section 4. Repealer. Port Orchard Municipal Code section 7.04.150 is hereby
repealed.
Section 5. Effective Date. This Ordinance shall be in full force and effect five (5) days
after posting and publication as required by law. A summary of this Ordinance may be published in lieu of the
entire Ordinance, as authorized by State law.
