1892 - Ordinance - Amending Chapter 2.64 Enforcement of Commerical VehiclesNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held January 27, 2003. ORDINANCE NO. 1892 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING CHAPTER 2.64 OF THE MUNICIPAL CODE AUTHORIZING ENFORCEMENT OF THE COMMERCIAL VEHICLE ORDINANCE BY THE CODE ENFORCEMENT OFFICER AND AMENDING A PORTION OF ORDINANCE NO. 1844. Copies of Ordinance No. 1892 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. (Amending a portion of Ordinance No. 1844) WHEREAS, Ordinance No. 1862, codified in Chapter 10.13 of the Po Orc Code, prohibits parking of commercial vehicles in residential and mixed-use zones; and ird I nicipz WHEREAS, when adopting Ordinance No. 1862. it was the City Council's intention that the ordinance be enforced by the code enforcement officer; now, therefore THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. Port Orchard Municipal Code section 2.64.030(1) is amended to read as follows: (1) A Civil Infraction. Any person who shall commit any violation of the provisions as set forth in this chapter shall have committed a civil infraction and, upon finding by the city of Port Orchard municipal court that such civil infraction has been committed, shall pay all billable court costs, and pay monetary penalty to the city of Port Orchard, as set forth in the schedule below (subsections below have been paraphrased as an aid in determining the monetary penalty only and are not intended for any other purpose): (a) Violation of the public nuisance laws: $100.00; (b) Violation of the zoning ordinance: $150.00; (c) Violation of the sign code: $250.00; (d) Violation of the conditions of approval for land use reclassification as approved by the city council: $1 50.00; (e) Violation of the conditions of approval for special use permits as approved by the city council: $150.00; (f) Violation of the conditions of approval for variances as approved by the planning commission: $150.00; (9) Violation of conditions of approval for final plats as approved by the City Council: $250.00; (h) Violation of the stormwater management ordinance: $100.00 to $1000.00; (i) Violation of the shoreline management program: $100.00 to $5000.00; (j) Violation of the critical areas ordinance: $100.00 to $1000.00; (k) Violation of the commercial vehicle parking ordinance: $250.00; Provided, any violation for which a penalty is not set forth above shall contain a monetary penalty not to exceed $100.00. Port Orchard Municipal Code section 2.64.040 is amended to read as (1) Section 2. follows: The enforcement authority of this chapter shall apply to the following ordinances and regulations of the city, and any subsequent ordinance andlor regulation as set forth in this chapter: (1) Nuisances: Ordinance No. 1724 and amendments thereto; Ordinance No. 1892 Page 2 of 2 (2) Zoning ordinance: Ordinance No. 1748 and amendments (3) Subdivisions: POMC Title 16; (4) Sign Code: Chapter 15.16 POMC; (5) Stormwater management ordinance: Chapter 15.32 POMC; (6) Critical areas ordinance: Ordinance No. 1784 and (7) Shoreline master program; (8) thereto; amendments thereto; Commercial vehicle parking ordinance: Chapter 10.1 3 POMC. SECTION 3. Severability.
