1912 - Ordinance - Vacating Unnamed AlleyCity of Port Orchard 216 Prospect Street Port Orchard, WA 98366 ORDINANCE NO. 1912 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON VACATING AN UNNAMED ALLEY LOCATED IN BLOCK 005 OF S.M. STEVENS EXTENDING EAST -WEST BETWEEN CLINE AVENUE AND AUSTIN AVENUE, AS SUBMITTED BY KITSAP COUNTY Public Right -of -Way: no Tax Parcel Number Assigned. Legal Description: Located in the NW 1/4 of the SW 1/4 of Section 26, Township 24N, Range 1E. An unnamed alley through Block 5, as shown on the Plat of S.M. Stevens' Town Plat of Sidney, as recorded in Volume 1, page 1, of Plats, Records of Kitsap County, Washington. WHEREAS, Kitsap County has submitted a Petition to Vacate an unnamed alley located in Block 005 of S.M. Stevens extending east -west between Cline Avenue and Austin Avenue, as legally described above, and said petition has been signed by all property owners abutting the portion of the alley to be vacated; and WHEREAS, in accordance with RCW 35.79.030 and Ordinance No. 1670, a Public Hearing was held Monday, August 25, 2003 in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington; and WHEREAS, the Petition to Vacate complies with the standards and requirements set forth in Ordinance No. 1670; and WHEREAS, the petitioners have paid the required fees and compensated the City as required by RCW 35.79.030 and Ordinance No. 1670, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: Ordinance No.1912 Page 2 of 2 SrC330N L The unnamed alley located in Block 005 of S.M. Stevens extending east -west between Cline Avenue and Austin Avenue, as identified in Exhibit "A" attached hereto and by reference incorporated herein, is hereby vacated. SECTION 7. The Mayor is hereby authorized and directed to execute a quit claim deed to said property, conveying the City's interest therein to Kitsap County subject to such easements as the City Engineer determines are necessary for utility purposes. SFC3:10N _3. This ordinance shall be in full force and effect 5 days after publication. A summary of this ordinance, as authorized by state statute, may be published.
