WHEREAS, Kitsap County submitted an application, dated May 30, 2003, requesting approval of a rezone from R8 to Community Facilities in conjunction with an application for a site specific plan on property legally described in Exhibits "A" and "B" to allow for the redevelopment of the property to construct a County administration building. The application was assigned City file number R-1147; and WHEREAS, a Mitigated Determination of Non -Significance was issued on June 9, 2003; and Ordinance No. 1913 Page 2 of 3 WHEREAS, the City of Port Orchard Planning Commission adopted Resolution 335-03 recommending approval of the requests for a rezone and site specific plan; and WHEREAS, the City Council held a public meeting on the application on August 25, 2003 WHEREAS, in December 2002 the area subject to the rezone request was approved for a Comprehensive Plan Amendment to redesignate the site from High Density Residential to Public and Community Spaces and the proposed development is consistent with the goals and policies of the Comprehensive Plan; and WHEREAS, the proposed rezone and site specific plan are not detrimental to the health, safety, and welfare of the community and are in harmony with the general purposes of the Zoning Ordinance, Growth Management Act, and Comprehensive Plan; and WHEREAS, being fully advised, the Council finds and concludes as follows: FINDINGS AND CONCLUSIONS The Council adopts the findings and conclusions of the planning staff report dated August 25, 2003 attached hereto as Exhibit "C" as its own. THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: Section 1. Based upon the recommendations of City Staff and the Planning Commission and the findings and conclusions contained herein, the City of Port Orchard Zoning Map, adopted by Ordinance No. 1748, is hereby amended by changing the zoning classification of the property described in Exhibit "A" from R8 to Community Facilities, subject to the conditions set forth in Planning Commission Resolution No. 335-03 attached hereto as Exhibit "D." Section 2. Based upon the recommendations of City Staff and the Planning Commission and the findings and conclusions contained herein, the site specific plan for the construction of a County administration building on the property generally located at 614 Division Street and legally described in Exhibits "A" and "B," application R-1147, is hereby approved, hereto attached as Exhibit E' subject to the conditions set forth in Planning Commission Resolution No. 335-03 attached hereto as Exhibit "D." Section 3. This rezone is site plan specific to the proposed construction of a County administration building on the property legally described in Exhibits "A" and "B," application R-1147. Pursuant to Part 2, Section 11 of the City of Port Orchard Planning and Development Procedures, any major modification, deviation or departure from the originally approved site plan or application shall constitute a violation of the zone adjustment approval unless the City Council has reviewed and approved a modified site plan after conducting a public hearing. The proposed rezone from R8-Residential to CF-Community Facilities supports the construction of a public agency administration building that has been identified as part of the Master Plan being considered by the County and the community. Port Orchard is the County Seat, and the community has fought to remain to be the host to the County government. The Community Facilities Zone is the appropriate zone for these facilities. 2. The proposal includes extensive streetscape and landscape improvements that will enhance the surrounding neighborhood and create an inviting atmosphere for residents and visitors through a landscape improvements. Connect of properties top the waterfront area will be enhanced with street improvements. 3. The proposal includes several public spaces through hardscaping and plantings that will be available to the nearby neighborhood, and general public. 4. The proposed rezone from R8 Residential to Community Facilities is in conformance with the Comprehensive Plan Designation for this site, and therefore the proposed rezone would maintain a balance mixture and distribution of land uses. 5. The proposal includes a building and site plan design that is intended to compliment the existing County campus, and the property setting as it slopes down the hill. The tiered building design will be constructed with green roofs and plazas that will effectively soften the mass of the building as seen from properties downslope looking up long the ridge line of the site. 6. A van accessible parking space is required by the Washington Administrative Code (WAC) 51-30. The proposal will be required to meet these specifications. 7. The applicant has submitted a landscape plan meeting city requirements, and has incorporated a public plaza into their design. 8. A Public Agency Office ( is a permitted use within the CIF zone (Ch B3, pg 98, "Use Tables"; Ch. B2, Section 90, pg 83 "Def. — land use's. 9. A Rezone to "Community Facilities" is consistent with the Comprehensive Plan designation of"Public and Community Spaces" for the site. 10. The applicant has provided a Site Specific Plan, pursuant to Ch. 1, Section 11e of the City's Planning and Development Procedures, Reso. 1844, that includes a site plan, landscape plan/streetscape plan, building elevation plan, stormwater control plan, parking/circulation plan as a consideration of Rezone Approval. 11. The applicant has requested that this site be Exempted by City Council from the provisions of the View Protection Ordinance, as outlined ord. 1785, Section 12. An analysis has been provided that addresses the criteria to be considered for Council Approval. 12. The applicant has requested specific City Council authorization to: a.) Utilize the City right-of-way for required parking, b.) Construction of public parking on County property, c.) Vacation of the alley found on -site, d.) Cline Avenue street pedestrian improvements that include a public stair climb, and, e.) The reduced parking stall lengths in the public right-of-way will the ability to utilize the full sidewalk width. The site plan illustrates the ability to adjusting the location or width of the sidewalk in order to compensate for the potential of parked vehicles extending over the sidewalk. 14. The site is served by City of Port Orchard for both the fire flow and domestic water. 15. The site is served by the City of Port Orchard for sewer. There is adequate capacity in the sewer system and treatment facility for this project. 16. Kitsap County is in the process of developing a master plan to meet the long-term needs of the county. The applicant intends to work closely with City staff, and surrounding residents to develop a mutually supported master plan for future development. 17. The proposed Administration Building is part of the Kitsap County Master Plan vision. Additional parking is intended within the proposed master plan area that will meet the intermediate, and long term needs of the County Campus. The master plan is contingent upon approval of a Comprehensive Plan Amendment approval. (currently on 2003 docket) 18. The project has presented a plan that illustrates the ability to meet the parking demand needs of the project, that will be provided in a manner as outlined in the Parking Plan as submitted. CONCLUSIONS: 1. The Rezone of the subject property, together with the site Specific Plan to construct a county Administration Building, is found to be consistent with City Resolution No. 1918, which authorizes expansion of County offices at this site, subject to development of a Master Plan, in conformance with City regulations. 2. The proposed Site Specific Plan which includes the proposed Building Elevation Plan, Site Plan, Landscape/Streetscape Plan, Stormdrainage Plan, and Parking/Circulation Plan is found to be consistent with the City's adopted Regulations regarding site development, and a furtherance of the interests of the City. 3. The applicant's request to have this site "Exempted from the provisions of the City's View Protection Ordinance has been found to be in conformance with the criteria setforth in Section 12 of Ord. 1785, and therefore, should be granted. 4. The Site Plan shall insure that there is no potential conflict between parked vehicles extending over the width of the sidewalk, to provide for a full 5 ft. of useable pedestrian space. 5. The application proposal demonstrates that appropriate provisions have been made to meet the parking needs of the proposed County Administration Building at this site; 6. The proposal, as conditioned, is found to be in conformance with the adopted goals and policies of the Comprehensive Plan, and; 7.
