1846 - Ordinance - Defining Planning Commission Authority and DutiesNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held February 25, 2002. ORDINANCE NO. 1846 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, DEFINING THE PLANNING COMMISSION AUTHORITY AND DUTIES AND AMENDING SECTION 1; PART A2; SUBSECTION 11 OF THE ZONING ORDINANCE, AS ADOPTED BY ORDINANCE NO. 1748. Copies of Ordinance No. 1846 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. WHEREAS, RCW 35.63 defines the powers of the Planning Commission; and WHEREAS, the City Zoning Ordinance specifies in greater detail the authority and duties of the Planning Commission of the City of Port Orchard, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 1; Part A2; Subsection 11 of the Port Orchard Zoning Ordinance is amended to read as follows: Section 11: Planning Commission -Authority and Duties a: The Planning Commission shall have all of the powers set forth in the Revised Code of Washington (RCW) Chapter 35.63, other provisions state law, and such additional powers as established by Council. b: The Planning Commission's powers shall include, but not be limited to: 1) When specifically requested by the City Council, the Planning Commission shall make studies and recommendations to the Council concerning goals, objectives, and policies governing all elements of the comprehensive plan relating to the growth, development, and redevelopment of the Port Orchard's corporate lands and the land in the surrounding Port Orchard urban growth area. When specifically requested by the City Council, the Planning Commission shall develop and make recommendations to the Council concerning policies, ordinances, administrative procedures, and other means for carrying out comprehensive plan elements in a coordinated and efficient manner. Making recommendations to the Council concerning proposed conditional use permits, proposed special use permits, proposed zoning map changes, and making recommendations on long plats as provided in state law and the Port Orchard subdivision ordinance. In carrying out such duties, the Planning Commission shall review available information, maintain an accurate record of the proceedings determine findings from the record, and form conclusions in support of recommendations. The findings and recommendations shall also set forth the manner in which the recommendation carries out and conforms to this ordinance. 2) 3) Ordinance No. 1846 Page 2 of 2 4) Processing variance applications, conducting public hearings related thereto, and rendering decisions thereon as described in this code or as delegated by the Council. In carrying out such duties, the Planning Commission shall review available information, maintain an accurate record of the proceedings, determine findings of fact from the record. and form conclusions in support of recommendations and decisions. The findings and conclusions shall also set forth the manner in which the recommendation or decision carries out and conforms to this ordinance.
