1848 - Ordinance - Creating Wastewater Treatment Facility Expansion FundNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held March 11, 2002. ORDINANCE NO. 1848 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, CREATING THE “WASTEWATER TREATMENT FACILITY EXPANSION FUND” FOR THE PURPOSE OF HANDLING THE REVENUES AND EXPENSES AS THE LEAD AGENCY FOR THE EXPANSION OF THE JOINT WASTEWATER TREATMENT FACILITY AND AUTHORIZING TRANSFERS. Copies of Ordinance No. 1848 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. WHEREAS, the City of Port Orchard and Karcher Creek Sewer District (formerly known as Kitsap County Sewer District No. 5) have an Intergovernmental Contract for Wastewater Facilities Management; and WHEREAS, on May 29,2001, the Council authorized the City of Port Orchard, as the lead agency for the expansion of the joint wastewater treatment facility, to apply for a Public Works Trust Fund Loan; and WHEREAS, on February 25,2002, the Council authorized the Mayor to sign the Public Works Trust Fund Loan for $10,000,000; now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: Section 1. There is hereby created a fund to be known as the "Wastewater Treatment Facility Expansion Fund." This fund shall be for the purpose of expanding the treatment capacity of the existing wastewater treatment facility, including the construction of physical, chemical and biological systems and improving existing processes. The project also includes the upgrade and expansion of the necessary appurtenant conveyance, equipment and treatment systems to be compatible with the plant expansion. Section 2. There shall be deposited into this fund, monies appropriate for the purposes of this project, including but not limited to, grants, loans, assessments, fees, interest earnings and the Facility Construction Fees from the Karcher Creek Sewer District. Section 3. There shall be transferred into this fund monies from the Water-Sewer Revenue Bonds, 1984 Fund (#405) that are ULlD #I assessments that have accumulated since the retirement of the 1984 Water-Sewer Revenue Bonds and the City Facility Construction Fees, collected to mitigate the future construction costs for the wastewater treatment facility, from the Water-Sewer Cumulative Reserve Fund (#403).
