Legal Description: NE% of the NW% of Section 25, Township 24, Range 1 E Full legal Exhibit "A" WHEREAS, a Petition to Vacate the westerly half of Farragut Avenue right-of-way, adjacent to tax parcel 4027-025-011-0005 (Prospect Court), legally described below, was received by the City, said petition being signed by all property owners abutting the portion of the street to be vacated; and WHEREAS, in accordance with RCW 35.79.030, a Public Hearing was held Monday, March 25, 2002 at 7:35 PM in the City Council Chambers, City Hall, 216 Prospect Street, Port Orchard, Washington, and WHEREAS, the City Council did vote to approve the Petition to Vacate the westerly half of Farragut Avenue right-of-way, adjacent to tax parcel 4027-025-01 1-0005 (platted as Prospect Court), as submitted by Donald and Frances Heng, and WHEREAS, the petitioners have compensated the City as required by RCW 35.79.030, now therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES ORDAIN AS FOLLOWS: SECTION 1. That the westerly half of Farragut Avenue right-of-way, adjacent to tax parcel 4027-025-01 1-0005 (Prospect Court), as described in Exhibit "A" attached hereto and by reference incorporated herein is hereby vacated. SECTION 2. The Mayor is hereby authorized and directed to execute a quit claim deed to said property, conveying the City's interest therein to the abutting property owner(s), subject to such easements as the City Engineer determines are necessary for City utility purposes. SECTION 3. This ordinance shall be in full force and effect 5 days after publication. A summary of this ordinance, as authorized by state statute, may be published.
