1857 - Ordinance - Amending Section 5.78 to Include the Definition of Solid WasteNOTICE OF CITY OF PORT ORCHARD ORDINANCE The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular Council meeting held May 13, 2002. ORDINANCE NO. 1857 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE 5.78 TO INCLUDE THE DEFINITION OF “SOLID WASTE”. Copies of Ordinance No. 1857 are available for review at the office of the City Clerk of the City of Port Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. Thirty days afler publication, copies of Ordinance No. 1857 will be provided at a nominal charge. Citv of Port Orchard Michelle Merlino Deputy Clerk Publish: Port Orchard Independent May 22,2002 Kitsapleeals~soundpublishin-. 0 corn ORDINANCE NO. 1857 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE CHAPTER 5.78 TO INCLUDE THE DEFINITION OF “SOLID WASTE WHEREAS, Ordinance No. 926, was codified January 14, 1974 establishing Chapter 5.78 imposing a Business and Occupation Tax of the gross receipts for charges for current garbage utility services; and WHEREAS, Ordinance No. 1577 amended Ordinance No. 926 and codified Section 5.78.010 Levy of Tax and 5.78.020 Payment of Tax; and WHEREAS, the term “solid waste” is not defined in Chapter 5.78 of the Port Orchard Municipal Code, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. of a new section 5.78.030 to read as follows: Chapter 5.78 of the Port Orchard Municipal Code is amended by the addition 5.78.030 Solid Waste Defined. As used in this chapter, “solid waste” means all putrescible and nonputrescible solid and semisolid wastes, including, but not limited to, garbage, rubbish, ashes industrial wastes, swill, sewage sludge, demolition and construction wastes, abandoned vehicles or parts thereof, recycled materials, and including biomedical waste, medical waste, and hazardous waste. SECTION 2. If any section, subsection, paragraph, sentence, clause, or phrase of this ordinance is declared unconstitutional or invalid for any reason, such decision.shall not affect the validity of the remaining portions of this ordinance. SECTION 3. This Ordinance shall be in full force and effect five (5) days after posting and publication as required by law. A summary of this Ordinance may be published in lieu ofthe entire Ordinance, as authorized by State law.
