Council meeting held May 28, 2002.
ORDINANCE NO. 1858
AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING PORT ORCHARD ZONING ORDINANCE NO. 1748; BY
AMENDING THE AREA AND USE MAPS THEREOF, RECLASSIFYING
THE SUBJECT PROPERTY (LOT 2 OF BLK 011 - A PORTION OF
R8 RESIDENTIAL TO RZO RESIDENTIAL, FOR THE PURPOSE OF
CORRECTING A SCRIVENER'S MAPPING ERROR. (Steve W. House,
owner of record).

Copies of Ordinance No. 1858 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1858 will be
provided at a nominal charge.

WHEREAS, Mr. Steven House, owner of record, has petitioned the city to
recognize the mapping error that occurred with the adoption of the Port Orchard Zoning Ordinance
Map No. 1748, to Reclassify the subject property from R8 to R20, (Exhibit “A) and
WHEREAS, it was the intent with the adoption of the 1998 Port Orchard Zoning
Map Ordinance No. 1748 approval to reflect a Residential - 20.0 unitslnet useable acre zone
designation for those properties designated as MF (Multi-Family) on the previous map, or as
otherwise specifically requested, and
WHEREAS, the subject property has been historically used for Multi-Family
residential purposes, and was authorized by Ordinance No. 1100 as part of the existing multi family
apartment complex; now, therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON DOES
ORDAIN AS FOLLOWS:
SECTION 1. THAT the Council of the City of Port Orchard does reclassify
property as described herein, from R8 to R20, and further amends the City’s Zoning Map to reflect
the change in the zone reclassification to support multi-family residential use of this property.
SECTION 2. CONCLUSION based upon the testimony of the subject property
owner and the information provided herein, the Port Orchard City Council does hereby conclude
that a scrivener’s error has occurred, and that granting the reclassification would not be detrimental
to the health, safety, morals, and general welfare of the community. [&.mG9 hodd ‘&Uh’‘

SECTION 3. If any section, subsection, paragraph, sentence, clause or phrase of
this ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the
validity or effectiveness of the remaining portions of this ordinance.
This Ordinance shall be in full force and effect five (5) days after
