ORDINANCE
The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held June 24, 2002.

AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
AMENDING CHAPTERS 5.12.080(1) AND 5.12.090 OF THE PORT
ORCHARD MUNICIPAL CODE ESTABLISHING A BUSINESS LICENSE
FEE AND AN ANNUAL RENEWAL FEE.
Copies of Ordinance No. 1863 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1863 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON,
AMENDING CHAPTERS 5.12.080(1) AND 5.12.090 OF THE PORT
ORCHARD MUNICIPAL CODE ESTABLISHING A BUSINESS LICENSE
FEE AND AN ANNUAL RENEWAL FEE.
WHEREAS, the City Council adopted Ordinance No. 1701 on December 22, 1997
thereby establishing business license regulations for the City; and
WHEREAS, Ordinance No. 1701 58A states, “There is no fee for a city business license.
(At this time there will be no application fee, annual fee, or renewal for a City business license. During
the first year, an analysis of implementation costs, ongoing costs, and increased sales tax revenue,
attributable to corrected reporting, will be done. If the City does not break even on ratio of costs to
revenue, fees will be charged in the future.)”; and
WHEREAS, City has identified the need to establish a business license fee and an
annual renewal fee; and
WHEREAS, after considering all information presented on this matter at a public meeting
held on June 10, 2002, it is the conclusion of the City Council that amendments to the city’s business
license regulations are warranted, now therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN THAT:
SECTION 1. Section 5.12.080 (1) of the Port Orchard Municipal Code is amended to
read as follows:
5.12.080 (1) Effective for business licenses issued for the July 2002-June 2003 period
and each year thereafter, a business license fee shall be required. The business license
fee shall be established by council resolution.
SECTION 2. Section 5.12.090 of the Port Orchard Municipal Code is amended to read
as follows:
5.12.090 Renewal.
(a) Renewal Process. ADDliCatiOnS for renewal of business licenses must be comoleted
and returned to ;he city license officer prior’to July 1st of each year. The city license officer shall send a
renewal notice to each licensee at the last address provided to the city. Failure of the licensee to receive any
such form shall not excuse the licensee from making application for and securing the required renewal
license. A business license shall expire on June 30th of the year following issuance, if not renewed as
described herein.
(b) Renewal fee. The annual business license renewal fee shall be established by council
resolution.

(c) Penalty fee. A penalty of ten dollars ($10) per month, which shall not be prorated, shall
be assessed on any delinquent license renewal, which has not been made on or before August 1st of any
year.
SECTION 3. If any section, subsection, paragraph, sentence, clause, or phrase of this
ordinance is declared unconstitutional or invalid for any reason, such decision shall not affect the validity
of the remaining portions of this ordinance.
SECTION 4. This Ordinance shall be in full force and effect five (5) days after posting
and publication as required by law. A summary of this Ordinance may be published in lieu of the entire
Ordinance, as authorized by State law.
