ORDINANCE NO. 1871 AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON, AMENDING PORT ORCHARD MUNICIPAL CODE SECTION 5.12.030 BY ADDING A NEW SUBSECTION PROVIDING AN EXEMPTION FROM OBTAINING A BUSINESS LICENSE FOR CERTAIN VENDORS AT NON-PROFIT FUNDRAISING EVENTS. Upon written request a statement of the full text of the Ordinance will be mailed to any interested person without charge. City of Port Orchard %&U Michelle Merlino Deputy Clerk Publish: Port Orchard Independent October 2, 2002 Kitsaple~alsO.soundoublish~e.com ORDINANCE NO. 1871 AN ORDINANCE OF THE CITY OF PORT ORCHARD, WASHINGTON AMENDING PORT ORCHARD MUNICIPAL CODE SECTION 5.12.030 BY ADDING A NEW SUBSECTION PROVIDING AN EXEMPTION FROM OBTAINING A BUSINESS FUNDRAISING EVENTS WHEREAS, pursuant to chapter 5.12 of the Port Orchard Municipal Code, the LICENSE FOR CERTAIN VENDORS AT NON-PROFIT City requires persons conducting business within the City to obtain a business license; and WHEREAS, the City Council deems it to be in the best interests of the citizens of Port Orchard to provide an exemption for certain vendors at fundraising events for nonprofit tax- exempt organizations, now, therefore, THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Section 5.12.030 the Port Orchard Municipal Code is amended by the addition of a new subsection (9) to read as follows: (9) Individual vendors at fundraising events held by tax-exempt nonprofit organizations described by section 501 (c)(3) (educational and charitable), (4) (social welfare), or (10) (fraternal societies operating as lodges) of the Internal Revenue Code, when the vending activities are conducted by the individual vendor for a period not exceeding a cumulative total of three days and constitute the vendor's only business activity within the city, and as a condition to participation in the event, the individual vendor pays a lump sum or a portion of the gross revenues to the nonprofit organization. SECTION 2. If any section, subsection, paragraph, sentence, clause or phrase of this ordinance is declared unconstitutional or invalid for any reason, such invalidity shall not affect the validity or effectiveness of the remaining portions of this ordinance. SECTION 3. This Ordinance shall be in full force and effect five (5) days afler posting and publication as required by law.
