The following is a summary of an Ordinance approved by the Port Orchard City Council at their regular
Council meeting held November 12,2002.

AN ORDINANCE OF THE CITY PORT ORCHARD, WASHINGTON,
MODIFYING CHAPTER 10.88 OF THE MUNICIPAL CODE TO INCLUDE
CERTAIN BOATING REGULATIONS.
Copies of Ordinance No. 1875 are available for review at the office of the City Clerk of the City of Port
Orchard. Upon written request a statement of the full text of the Ordinance will be mailed to any
interested person without charge. Thirty days after publication, copies of Ordinance No. 1875 will be
provided at a nominal charge.

AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF
PORT ORCHARD MODIFYING CHAPTER 10.88 OF THE
MUNICIPAL CODE TO INCLUDE CERTAIN BOATING
REGULATIONS
WHEREAS, RCW 79A.60, 88.02. and 88.28 and WAC 308-93 and 352-60 contain
provisions for the regulation of vessels, and
WHEREAS, the City of Port Orchard desires to be able to enforce these regulations in Port
Orchard Municipal Court; now therefore,
THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES
HEREBY ORDAIN AS FOLLOWS:
Section I. Section 10.88.010 of the Port Orchard Municipal Code is amended to read
as follows:
10.88.010 Adoption by reference. The following sections of the Revised Code
of Washington (RCW) and the Washington Administrative Code (WAC), and any
amendments thereto, are adopted by reference, and are included in this chapter
as if fully set forth herein: RCW 79A.60.010. 79A.60.020. 79A.60.030,
79A.60.040, 79A.60.080, 79A.60.120, 79A.60.130, 79A.60.140, 79A.60.150,
79A60.160, 79A.60.170, 79A.60.180, 79A.60.190. 79A.60.200, 88.02.010.
88.02.020, 88.02.023, 88.02.030, 88.02.078, 88.02.090, 88.02.110, 88.02.112,
88.02.1 18, 88.02.125, 88.28.050, WAC 308-93-140. 308-93-145. 352-60-010,
352-60-020, 352-60-030, 352-60-040, 352-60-050, 352-60-060, 352-60-070,
352-60-080. 352-60-090, 352-60-1 00, and 352-60-1 20.
Section 2. Chapter 10.88 of the Port Orchard Municipal Code is amended by the
addition of new section 10.88.015 to read as follows:
10.88.015 Penalty
(1) Except where the violation is classified as a misdemeanor or gross
misdemeanor, a violation of any provision of this chapter shall be classified as a
civil infraction. Unless otherwise provided, a person found to have committed an
infraction under this chapter shall be assessed a monetary penalty which may
not exceed $500.00.
(2) Unless otherwise provided, a person convicted of a misdemeanor
offense under this chapter shall be punished as provided in POMC 9.02.050(1).
(3)

Section 3. Effective Date. This Ordinance shall be in full force and effect five (5) days
afler posting and publication as required by law. A summaly of this Ordinance may be published in lieu of the
entire Ordinance, as authorized by State law.
