A 2.5 acre portion of the property to be annexed was recently acquired by the City to be used for municipal sewerage purposes as an integral part of the City's wastewater treatment facility; and WHEREAS, a 2.7 acre portion of this property was annexed into the City in 1983 by Ordinance No. 1236; and WHEREAS, on February 15, 2000 the City of Port Orchard and the Veteran's Home, Washington Department of Veterans Affairs filed a Declaration of Boundary Line Adjustment correcting the boundaries and legal description of the property annexed in 1983; and WHEREAS, it is the intent of the city with concurrence by county assessor's office to combine the two parcels into one tax parcel upon annexation; and WHEREAS, it has been agreed the best method of correcting the legal description as stated within Ordinance No.1236 and to prepare for combining the two parcels is to describe the property with one legal description; and WHEREAS, RCW 35.13.180 provides for annexation of property for municipal purposes; and WHEREAS, this property is to be used for wastewater treatment facility purposes, now, therefore THE CITY COUNCIL OF THE CITY OF PORT ORCHARD, WASHINGTON, DOES HEREBY ORDAIN AS FOLLOWS: SECTION 1. Ordinance No. 1236 is hereby repealed in its entirety. SECTION 2. THAT the following described territory owned by the City of Port Orchard and non- contiguous to the City of Port Orchard be and the same hereby is annexed to the City of Port Orchard for municipal purposes and from and after the effective date of this Ordinance shall be and become subject to all the Laws and Ordinances thereof.
